മുട്ടിൽ മരംമുറിക്കേസ് - പ്രതികളുടെ മുൻകൂർ ജാമ്യാപേക്ഷ ഹൈക്കോടതി തള്ളി

വയനാട്ടിലെ മുട്ടിൽ സൗത്ത് വില്ലേജിലെ വനഭൂമിയിൽനിന്ന് ഈട്ടി തടി മുറിച്ചു കടത്തിയ കേസിലെ പ്രതികളുടെ മുൻകൂർ ജാമ്യാപേക്ഷ ഹൈക്കോടതി തള്ളി. വയനാട് വാഴവറ്റ മൂറ്റാനാനിയിൽ ആൻ്റോ അഗസ്റ്റിൻ, ജോസുകുട്ടി അഗസ്റ്റിൻ, റോജി അഗസ്റ്റിൻ എന്നിവരുടെ ഹർജിയാണ് കോടതി തള്ളിയത്. റിസർവ് മരങ്ങളാണു പ്രതികൾ മുറിച്ചു നീക്കിയതെന്നും കോടിക്കണക്കിനു രൂപയുടെ വനംകൊള്ള നടന്നിട്ടുണ്ടെന്നും പ്രതികളെ കസ്റ്റഡിയിൽ ചോദ്യം ചെയ്യേണ്ടതിനാൽ മുൻകൂർ ജാമ്യം അനുവദിക്കരുത് എന്നുമുള്ള സർക്കാർ വാദം അംഗീകരിച്ചാണ് കോടതി ഉത്തരവ്.

വനം വകുപ്പു റജിസ്റ്റർ ചെയ്ത കേസ് റദ്ദാക്കണം എന്നാവശ്യപ്പെട്ടു പ്രതികൾ നേരത്തെ സമർപ്പിച്ച ഹർജി ഹൈക്കോടതി തള്ളിയിരുന്നു. സ്വന്തം ഉടമസ്ഥതയിലുള്ള ഭൂമിയിലെ മരങ്ങളാണു വെട്ടിയതെന്നും അതു വനഭൂമിയല്ലെന്നുമായിരുന്നു വില്ലേജ് ഓഫിസറുടെ രേഖകൾ സമർപ്പിച്ച് പ്രതികൾ അവകാശപ്പെട്ടത്. വനം വകുപ്പിന്റെ അനുമതിയോടെയായിരുന്നു മരം വെട്ടിയത്. പട്ടയ ഭൂമിയിലെ മരം വെട്ടാൻ അനുവദിച്ചുകൊണ്ടുള്ള 2020 മാർച്ച് 11ലെയും ഒക്ടോബർ 24ലെയും ഉത്തരവുകൾ പ്രകാരമാണ് മരം മുറിച്ചതെന്നുമായിരുന്നു പ്രതികളുടെ വാദം.

The High Court rejected the anticipatory bail of the accused in the case of cutting down the tree from the forest land in Muttil South Village of Wayanad. The court dismissed the petition of Anto Augustine, Josukutty Augustine and Roji Augustine in Wayanad Vazhavatta Mutananiyil. The court order accepted the government's contention that the accused had cut down reserve trees, forest looting worth crores of rupees and anticipatory bail should not be granted as the accused were to be questioned in custody.

The high court had rejected an earlier petition filed by the accused seeking quashing of the case registered by the forest department. The accused claimed by submitting the village officer's records that the trees on the land they owned had been cut down and not forest land. The tree was cut down with the approval of the forest department. The accused claimed that the tree was cut down on orders of March 11 and October 24, 2020 allowing the felling of trees on Pattaya land.
