ഐ എസ് ഐ എസ് വിധവ ആയിഷയെ തിരിച്ചു കൊണ്ടുവരണം, സുപ്രീംകോടതിയില്‍ ഹര്‍ജി
അഫ്ഗാനിസ്താനില ജയിലില്‍ കഴിയുന്ന മലയാളിയായ ഐഎസ് വിധവ ആയിഷയെ ഇന്ത്യയിലേക്ക് മടക്കി കൊണ്ട് വരാന്‍ കേന്ദ്രസർക്കാരിനോട് നിര്‍ദേശിക്കണം എന്നാവശ്യപ്പെട്ട് സുപ്രീം കോടതിയില്‍ ഹര്‍ജി. ആയിഷയുടെ പിതാവ് വി ജെ സെബാസ്റ്റ്യന്‍ ഫ്രാന്‍സിസ് ആണ് സുപ്രീംകോടതിയെ സമീപിച്ചത്. രാജ്യ സുരക്ഷയ്ക്ക് ഭീഷണി അല്ലാത്തതിനാല്‍ രാജ്യാന്തരതലത്തില്‍ തന്നെ വനിതാ ഭീകരവാദികളോട് മൃദു സമീപനമാണ് രാജ്യങ്ങള്‍ സ്വീകരിക്കുന്നത് എന്ന് ഹര്‍ജിയില്‍ ചൂണ്ടികാട്ടുന്നു.
അഫ്ഗാനിസ്ഥാനിലെ പുല്‍ ഇ ചര്‍ക്കി ജയിലിലാണ് നിലവില്‍ ആയിഷ എന്ന സോണിയ സെബാസ്റ്റ്യനും ഏഴ് വയസുള്ള മകളും തടവില്‍ കഴിയുന്നത്. ആയിഷയുടെ ഭര്‍ത്താവ് 2019 ല്‍ നാറ്റോ സഖ്യ സേന നടത്തിയ ബോംബാക്രമണത്തില്‍ കൊല്ലപ്പെട്ടിരുന്നു. അയിഷയും മകളും ഭീകരവാദ പ്രവര്‍ത്തനത്തില്‍ സജീവം ആയിരുന്നില്ല എന്നും സുപ്രീം കോടതിയില്‍ ഫയല്‍ ചെയ്ത ഹര്‍ജിയില്‍ ചൂണ്ടിക്കാട്ടിയിട്ടുണ്ട്.
യുഎപിഎ നിയമപ്രകാരം ആയിഷയ്‌ക്കെതിരെ എന്‍ ഐ എ കേസ് രജിസ്റ്റര്‍ ചെയ്തിട്ടുണ്ട്. ഇന്ത്യയില്‍ എത്തിച്ച ശേഷം ഈ കേസില്‍ വിചാരണ നടത്തണമെന്നാണ് സുപ്രീം കോടതിയില്‍ ഫയല്‍ ചെയ്തിരിക്കുന്ന ഹര്‍ജിയില്‍ ആവശ്യപ്പെട്ടിരിക്കുന്നത്. അമേരിക്കന്‍ സേന അഫ്ഗാനിസ്ഥാനില്‍ നിന്ന് പിന്മാറിയതോടെ കാബൂളില്‍ ജയിലില്‍ കഴിയുന്നവരുടെ സുരക്ഷ അനിശ്ചിത്വത്തില്‍ ആയെന്നും ഹര്‍ജിയില്‍ വ്യക്തമാക്കിയിട്ടുണ്ട്. അയിഷയെ ഇന്ത്യയിലേക്ക് മടക്കി കൊണ്ട് വരാത്തത് ഭരണഘടന ഉറപ്പ് നല്‍കുന്ന മൗലിക അവകാശങ്ങളുടെ ലംഘനമാണെന്നും സെബാസ്റ്റ്യന്‍ ആരോപിച്ചിട്ടുണ്ട്.
അഭിഭാഷകന്‍ രഞ്ജിത് മാരാരാണ് ആയിഷയുടെ പിതാവിന്റെ റിട്ട് ഹര്‍ജി സുപ്രീം കോടതിയില്‍ ഫയല്‍ ചെയ്തിരിക്കുന്നത്.
A petition was filed in the Supreme Court seeking directions to the Central government to bring back ISIS widow Ayesha to India, a Malayali jailed in Afghanistan. Ayesha's father, VJ Sebastian Francis, approached the Supreme Court. The petition points out that countries are taking a soft approach to women terrorists internationally as they are not a threat to national security.
Ayesha, a Sonia Sebastian, and her seven-year-old daughter are currently being held in Pul-e-Charkhi prison in Afghanistan. Ayesha's husband was killed in a 2019 bombing by NATO coalition forces. The petition filed in the Supreme Court also noted that Aisha and her daughter were not active in terrorist activities.
The NIA has registered a case against Ayesha under the UAPA Act. The petition filed in the Supreme Court has sought a trial in the case after being brought to India. The petition also stated that the security of those in jail in Kabul was uncertain after US forces withdrew from Afghanistan. Sebastian has also alleged that the non-return of Aisha to India is a violation of the fundamental rights guaranteed by the Constitution.
