നടിയെ ആക്രമിച്ച കേസ് - വിചാരണ വിചാരണയ്ക്ക് കൂടുതൽ സമയം വേണമെന്ന ആവശ്യം തള്ളി സുപ്രീംകോടതി

നടൻ ദിലീപ് പ്രതിയായ നടിയെ ആക്രമിച്ച കേസിലെ വിചാരണയ്ക്ക് കൂടുതൽ സമയം അനുവദിക്കണമെന്ന സംസ്ഥാന സർക്കാരിൻ്റെ ആവശ്യം സുപ്രീം കോടതി നിരാകരിച്ചു. ഇക്കാര്യത്തിൽ വിചാരണയ്ക്ക് കൂടുതൽ സമയം ആവശ്യമെങ്കിൽ വിചാരണക്കോടതി, സുപ്രീം കോടതിയെ സമീപിച്ചാൽ ആവശ്യം പരിഗണിക്കാമെന്നും സുപ്രീം കോടതി ജഡ്ജി എ എം ഖാൻവിൽക്കർ അധ്യക്ഷനായ ബെഞ്ച് വ്യക്തമാക്കി.

വിചാരണ പൂർത്തിയാക്കാൻ 6 മാസം കൂടി സമയം അനുവദിക്കണമെന്ന് കേരള സർക്കാരിനു വേണ്ടി ഹാജരായ ജയദീപ് ഗുപ്ത ആവശ്യപ്പെട്ടു. വിചാരണ പൂർത്തിയാക്കപ്പെടേണ്ടതുണ്ടെന്നു വ്യക്തമാക്കിയ കോടതി ദിലീപിനു വേണ്ടി ഹാജരായ മുകുൾ റോഹത്ഗിയുടെ അഭിപ്രായം തേടി. പല രീതിയിൽ വിചാരണ നീട്ടിക്കൊണ്ടുപോകാനാണ് സംസ്ഥാന സർക്കാർ ശ്രമിക്കുന്നതെന്ന് പറഞ്ഞ അദ്ദേഹം വിചാരണ നീട്ടുന്നതിനെ എതിർത്തു.

ആദ്യം കേസിൽ ജഡ്ജിയെ മാറ്റാൻ ശ്രമിച്ചു, അതു നടക്കാതെ വന്നപ്പോൾ പ്രോസിക്യൂട്ടർ രാജിവച്ചു. കേസിൽ 4 തവണയാണ് സമയം നീട്ടിനൽകിയതെന്നും സംസ്ഥാന സർക്കാർ ഇക്കാര്യത്തിൽ മോശം കളി കളിക്കുകയാണെന്നും ദിലീപിന് വേണ്ടി ഹാജരായ മുകുൾ റോഹത്ഗി പറഞ്ഞു. വിചാരണ നീട്ടണമെന്ന ആവശ്യം നേരത്തെ തന്നെ സമർപ്പിക്കപ്പെട്ടതാണെന്നും റോഹത്ഗി പറഞ്ഞു. കേസിൽ പുതിയ തെളിവുകളുണ്ടെന്നും ഇതു അവഗണിക്കാൻ കഴിയില്ലെന്നും ചൂണ്ടിക്കാട്ടിയ സംസ്ഥാന സർക്കാർ, പ്രതിഭാഗം ഇതാദ്യമായാണ്  ഇത്തരമൊരു ആരോപണം സംസ്ഥാന സർക്കാറിനെതിരെ കോടതിയിൽ നടത്തുന്നതെന്നും പറഞ്ഞു. ഇതേ തുടർന്നാണ് വിചാരണ കോടതി ജഡ്ജി ആവശ്യമുന്നയിച്ചാൽ പരിഗണിക്കാമെന്നു കോടതി വ്യക്തമാക്കിയത്. 

The Supreme Court has rejected a plea by the state government to allow more time for trial in the case of actor Dileep's assault on actress. The bench, headed by Supreme Court Judge AM Khanwilker, said the trial court could consider the matter if it needed more time to approach the apex court. Jayadeep Gupta, appearing for the Kerala government, asked for another six months to complete the trial. The court sought the opinion of Mukul Rohatgi, who appeared for Dileep, stating that the trial should be completed. He said the state government was trying to prolong the trial in various ways and opposed the extension.

At first he tried to change the judge in the case, but when that did not happen, the prosecutor resigned. Mukul Rohatgi, who appeared for Dileep, said that the case had been extended four times and that the state government was playing a bad game in the matter. Rohatgi said the demand for an extension of the trial had already been submitted. The state government pointed out that there was new evidence in the case and this could not be ignored, adding that this was the first time the respondent had made such an allegation against the state government in court. Following this, the trial court judge said that he would consider the request if necessary.
