ബിഷപ് ഫ്രാങ്കോ മുളയ്ക്കൽ കോടതി വിധി ഒരു കാരണവശാലും അംഗീകരിക്കാൻ കഴിയില്ലെന്നു കേസന്വേഷണത്തിനു മേൽനോട്ടം നൽകിയ കോട്ടയം മുൻ ജില്ലാ പൊലീസ് മേധാവി എസ് ഹരിശങ്കർ. ഇന്ത്യയിൽത്തന്നെ വേറിട്ടു നിൽക്കുന്ന വളരെ അസാധാരണമായതും അത്ഭുതകരവുമായ കോടതി വിധിയാണിതെന്നും ഇതിനെതിരെ അപ്പീൽ നൽകുമെന്നും അദ്ദേഹം പറഞ്ഞു. പീഡനക്കേസിൽ ഇരയുടെ മാനസികാവസ്ഥയും മൊഴിയും ഉൾക്കൊണ്ടാണു മേൽക്കോടതികളുടെ വിധികളുണ്ടായിട്ടുള്ളതെന്ന് ഹരിശങ്കർ‌ പറഞ്ഞു. ഇരയുടെ മൊഴി തെളിവായി സ്വീകരിക്കാമെന്ന നിർദേശം സുപ്രീംകോടതിയും നൽകിയിട്ടുണ്ട്. ആ സാഹചര്യത്തിൽ ഇങ്ങനൊരു വിധിയെ വളരെ ഞെട്ടലോടെയാണ്  നോക്കിക്കാണുന്നത്. ഈ വിധിക്കൊരു സാമൂഹിക വീക്ഷണം കൂടിയുണ്ട്.

ഒരു കന്യാസ്ത്രീ അവർക്കു കിട്ടിയ അവസാന കച്ചിത്തുരുമ്പിൽ പിടിച്ചുകയറി നീതിക്കായി ഇവിടെ വരെ പോരാടിയ കേസാണിത്. സംരക്ഷിക്കേണ്ടവർ തന്നെ പീഡകരാകുന്ന ഒരുപാട് ഇടങ്ങളുണ്ട്, അങ്ങോനൊന്നാണിതും. അവിടെയെല്ലാം നിശബ്ദരായ ഒരുപാട് ഇരകളുമുണ്ട്. ജീവനു ഭീഷണിയുള്ളതുകൊണ്ടാണ് അവരൊക്കെ പീഡനം പുറത്തുപറയാൻ മടിക്കുന്നത്. അങ്ങനെയുള്ളവർക്ക് ഈ കോടതി വിധി എന്തു സന്ദേശമാണു നൽകുന്നത്? അവർ ആജീവനാന്തം നിശബ്ദരായിക്കഴിയണമെന്നാണ് ഈ വിധിയിലൂടെ കോടതി പറയുന്നതെങ്കിൽ അതു സമൂഹത്തിനു നൽകുന്നതു തെറ്റായ സന്ദേശമാണ്. പ്രതിഭാഗം ഹാജരാക്കിയ സാക്ഷികളാരും ഒരു വസ്തുതയും വിശ്വസനീയമായി പറയാൻ കഴിയുന്നവരായിരുന്നില്ല. പ്രോസിക്യൂഷൻ്റെ സാക്ഷികൾ വളരെ കൃത്യമായി മൊഴി നൽകുകയും ചെയ്തു. എന്തു വ്യാഖ്യാനമാണ് കോടതി നടത്തിയിട്ടുള്ളതെന്നു വിധിപ്പകർപ്പ് ലഭിച്ചാലേ അറിയാനാകൂ. സാക്ഷികളായ കന്യാസ്ത്രീകൾക്കു സുരക്ഷ നൽകുമെന്നും ഹരിശങ്കർ ഐ പി എസ് പറഞ്ഞു.

കന്യാസ്ത്രീയെ ബലാത്സംഗം ചെയ്തെന്ന കേസില്‍ ഫ്രാങ്കോ മുളയ്ക്കലിനെ വിചാരണ കോടതി കുറ്റവിമുക്തനാക്കി

Former Kottayam district police chief S Harishankar, who oversaw the case, said the Bishop Franco Mulaikkal court verdict could not be accepted for any reason. He said that this was a very unusual and miraculous court decision which was unique in India and that an appeal would be lodged against it. Harishankar said that the judgments of the higher courts were based on the mental state and statement of the victim in the torture case. The Supreme Court has also directed that the victim's statement be accepted as evidence. In that case, such a verdict would come as a shock. There is also a social perspective to this verdict.

This is the case of a nun who got caught in the last straw she got and fought so far for justice. There are many places where those who need to be protected are oppressed, and that is one of them. There are a lot of silent victims out there. They are reluctant to disclose the persecution because it is life threatening. What message does this court ruling send to such people? If the court says in this judgment that they should remain silent for life, it is sending the wrong message to the society. None of the witnesses presented by the respondent could testify to any fact. Prosecution witnesses testified very accurately. What interpretation the court has made will be known only after receiving the verdict. Harishankar IPS said that security will be provided to the nuns who are witnesses.
