സിൽവർ ലൈൻ - രണ്ട് ഹര്‍ജികള്‍ ഹൈക്കോടതി തള്ളി. സര്‍ക്കാരിന് തുടര്‍നടപടികളുമായി മുന്നോട്ട് പോകാം

കെ-റെയിലിനെതിരായ രണ്ട് ഹര്‍ജികള്‍  ഹൈക്കോടതി തള്ളി. സിൽവർലൈനായി സംസ്ഥാന സര്‍ക്കാരിന് ഭൂമി ഏറ്റെടുക്കാൻ അധികാരമില്ലെന്ന് കാണിച്ച് സമർപ്പിച്ച രണ്ട് ഹര്‍ജികളാണ് ജസ്റ്റിസ് എൻ നഗരേഷ് തള്ളിയത്. സംസ്ഥാന സര്‍ക്കാരിന് തുടര്‍നടപടി സ്വീകരിക്കാമെന്ന വാദം കോടതി അംഗീകരിച്ചു.

കെ-റെയില്‍ ഒരു പ്രത്യേക റെയില്‍വേ പദ്ധതിയാണെന്നും, അതുകൊണ്ടുതന്നെ കേന്ദ്രസര്‍ക്കാരിൻ്റെ വിജ്ഞാപനമില്ലാതെ ഭൂമി ഏറ്റെടുക്കലോ പദ്ധതി നിര്‍വഹണമോ സംസ്ഥാന സര്‍ക്കാരിന് സാധ്യമല്ലെന്നായിരുന്നു ഹര്‍ജിക്കാരുടെ വാദം. എന്നാല്‍ കെ-റെയില്‍ ഒരു പ്രത്യേക പദ്ധതിയല്ലെന്നും, സാധാരണ റെയില്‍വേ പദ്ധതി മാത്രമാണെന്നും സംസ്ഥാന സര്‍ക്കാര്‍ കോടതിയെ അറിയിച്ചു.

കെ-റെയിൽ പ്രത്യേക റെയില്‍വേ പദ്ധതിയുടെ പട്ടികയിലേക്ക് വന്നുകഴിഞ്ഞാല്‍ ഇതുസംബന്ധിച്ച് പ്രത്യേക വിജ്ഞാപനം പുറത്തിറക്കേണ്ടതുണ്ട്. എന്നാൽ പ്രത്യേക റെയില്‍വേ പദ്ധതിയല്ലാത്തതിനാല്‍ സ്ഥലം ഏറ്റെടുപ്പ്, പദ്ധതി നിര്‍വഹണം എന്നിവയ്ക്ക് സര്‍ക്കാരിന് അധികാരമുണ്ടെന്ന് സംസ്ഥാന സര്‍ക്കാര്‍ കോടതിയെ അറിയിച്ചു. ഈ വാദം ഹൈകോടതി അംഗീകരിക്കുകയും ചെയ്തു.

The High Court dismissed two petitions against K-Rail. Justice N Nagaresh dismissed two petitions filed by the state government alleging that it did not have the power to acquire land for the Silver Line. The court accepted the argument that the state government could take further action.

The petitioners contended that K-Rail was a separate railway project and therefore the State Government could not acquire land or carry out the project without the notification of the Central Government. However, the state government told the court that K-Rail was not a separate project but a normal railway project.

Once K-Rail is included in the list of special railway projects, a special notification will have to be issued in this regard. However, the state government told the court that the government has the power to acquire land and carry out the project as it is not a separate railway project. The High Court accepted this argument.
