പെഗാസസ് - വാർത്തകൾ ശരിയെങ്കിൽ ഫോണ്‍ ചോര്‍ത്തല്‍ വിഷയം ഗുരുതരമെന്ന് സുപ്രീംകോടതി
പത്രമാധ്യമങ്ങളില്‍ വന്ന വാര്‍ത്തകള്‍ ശരിയെങ്കില്‍ പെഗാസസ് ഫോണ്‍ ചോര്‍ത്തല്‍ ഗുരുതരവിഷയമാണെന്ന് സുപ്രീം കോടതി. കേസില്‍ സ്വതന്ത്രാന്വേഷണം ആവശ്യപ്പെട്ടുള്ള അഞ്ച് ഹര്‍ജികള്‍ പരിഗണിക്കവേയാണ് കോടതിയുടെ സുപ്രധാന നിരീക്ഷണം. 2019ല്‍ തന്നെ ഇതുമായി ബന്ധപ്പെട്ട വിവരങ്ങള്‍ പുറത്ത് വന്നപ്പോള്‍ എന്തുകൊണ്ട് ഔദ്യോഗികമായി പരാതി നല്‍കിയില്ലെന്നും ചീഫ് ജസ്റ്റിസ് ആരാഞ്ഞു. ഐടി ആക്ട് പ്രകാരം അന്നുതന്നെ കേസ് നല്‍കാമായിരുന്നിട്ടും എന്തു കൊണ്ട് അങ്ങനെയൊരു നടപടി ഉണ്ടായില്ലെന്നും കോടതി ചോദിച്ചു.
2019 ല്‍ വിഷയം ശ്രദ്ധയില്‍പ്പെട്ടപ്പോള്‍ തന്നെ വാട്‌സ്ആപ്പ് കാലിഫോര്‍ണിയയിലെ കോടതിയെ സമീപിച്ചിരുന്നെന്നും ഇപ്പോള്‍ മാത്രമാണ് ഫോണ്‍ ചോര്‍ത്തപ്പെട്ടവരുടെ വിവരങ്ങള്‍ പുറത്തുവന്നതെന്നും മാധ്യമപ്രവര്‍ത്തകരായ എന്‍ റാം, ശശികുമാര്‍ എന്നിവര്‍ക്ക് വേണ്ടി ഹാജരായ അഭിഭാഷകന്‍ കപില്‍ സിബല്‍ പറഞ്ഞു. സര്‍ക്കാരിന് മാത്രമാണ് ഈ സോഫ്റ്റ് വെയര്‍ കമ്പനി വിൽക്കുന്നത്. വിവരങ്ങള്‍ ഇസ്രായേല്‍ കമ്പനിയായ എന്‍ എസ്ഒ യ്ക്ക് കൈമാറി. ഇത് ഗുരുതരമാണെന്നും ദേശീയ സുരക്ഷയെ ബാധിക്കുന്ന വിഷയമായതിനാല്‍ ഈ കാര്യത്തില്‍ കേന്ദ്രം വിശദീകരണം നല്‍കേണ്ടതുണ്ടെന്നും കബില്‍ സിബല്‍ കോടതിയെ ബോധിപ്പിച്ചു. കേന്ദ്രത്തിന് നോട്ടീസ് നല്‍കണമെന്നും കബില്‍ സിബല്‍ ആവശ്യപ്പെട്ടു.
എന്നാല്‍ വാര്‍ത്താധിഷ്ടിതമായാണ് ഹര്‍ജികള്‍ വന്നതെന്നും കേസ് മുന്നോട്ട് കൊണ്ട് പോകാന്‍ കൂടുതല്‍ തെളിവുകള്‍ ആവശ്യമാണെന്നും കോടതി പറഞ്ഞു. ഫോണ്‍ ചോര്‍ത്തിയതില്‍ ആരെങ്കിലും പരാതി നല്‍കിയിട്ടുണ്ടെങ്കില്‍ അത് വ്യക്തമാക്കണമെന്നും, ഹർജികൾ കേന്ദ്രസർക്കാറിന് നൽകണമെന്നും കോടതി പറഞ്ഞു. അടുത്ത ചൊവ്വാഴ്ച ഹര്‍ജി വീണ്ടും പരിഗണിക്കും.
The Supreme Court said that if the reports in the press were correct, pegasus phone hacking was a serious matter. The court's important observation came as it considered five petitions seeking an independent inquiry into the case. The Chief Justice also asked why no official complaint was lodged when the information in this regard came out as early as 2019. The court also asked why such action could have been taken even though the case could have been filed on the same day under the IT Act.
Advocate Kapil Sibal, appearing for media persons N Ram and Shashi Kumar, said WhatsApp had approached the California court as soon as the matter came into consideration in 2019 and only now the information of those who had been telephoned had emerged. The software company is sold only by the government. The information was passed on to the Israeli company NSO. Kapil Sibal informed the court that this was serious and the Centre had to clarify the matter as it was a matter of national security. Kapil Sibal also demanded a notice to the Centre.
