വാക്സീൻ നിബന്ധനകൾ പാലിക്കാത്തതിൻ്റെ പേരിൽ ഓസ്ട്രേലിയയിൽ തടയപ്പെട്ട സെർബിയൻ ടെന്നിസ് താരം നൊവാക് ജോക്കോവിച്ച് ഓസീസ് സർക്കാരിനെതിരായ നിയമ പോരാട്ടത്തിൽ വിജയിച്ചുവെങ്കിലും പ്രതിസന്ധി ഒഴിയുന്നില്ല. വാക്സീൻ നിബന്ധനകൾ പാലിക്കാത്തതിന് താരത്തിൻ്റെ വീസ റദ്ദാക്കിയ ഓസ്ട്രേലിയൻ സർക്കാരിൻ്റെ നടപടി ഫെഡറൽ സർക്യൂട്ട് കോടതി മരവിപ്പിച്ചിരുന്നു. ഇതേതുടർന്ന് തടഞ്ഞുവച്ചിരിക്കുന്ന താരത്തെ വിട്ടയയ്ക്കാനും കോടതി ഉത്തരവിട്ടു. ഉത്തരവ് പുറത്തിറങ്ങി 30 മിനിറ്റിനകം ജോക്കോവിച്ചിനെ വിട്ടയയ്ക്കണമെന്നായിരുന്നു നിർദ്ദേശം. ഇതനുസരിച്ച് ഓസ്ട്രേലിയൻ അധികൃതർ താരത്തെ വിട്ടയക്കുകയും ചെയ്തു. എന്നാൽ കോടതി വിധിയുടെ പിൻബലത്തിൽ ഓസ്ട്രേലിയയിൽ തുടരുന്ന നൊവാക് ജോക്കോവിച്ചിൻ്റെ വീസ രാജ്യത്തെ ഇമിഗ്രേഷൻ മന്ത്രിയുടെ പ്രത്യേക അധികാരം ഉപയോഗിച്ച് ഓസ്ട്രേലിയൻ സർക്കാർ വീണ്ടും റദ്ദാക്കി. ഇതോടെ താരത്തെ ഉടൻ ഓസ്ട്രേലിയയിൽനിന്ന് നാടുകടത്തും. ഫലത്തിൽ നിലവിലെ ചാംപ്യനായ ജോക്കോവിച്ചിന് ഈ വർഷത്തെ ഓസ്ട്രേലിയൻ ഓപ്പണിൽ കളിക്കാനാകില്ലെന്ന് ഏതാണ്ട് ഉറപ്പായി. ഓസ്ട്രേലിയൻ ഓപ്പൺ അധികൃതർ ടൂർണമെൻ്റിൽ താരത്തിൻ്റെ പങ്കാളിത്തം ഉറപ്പാക്കി സീഡിങ്ങും മത്സരക്രമവും പ്രഖ്യാപിച്ചതിനു പിന്നാലെയാണ് ഓസ്ട്രേലിയൻ സർക്കാർ ഇമിഗ്രേഷൻ മന്ത്രിയുടെ സവിശേഷാധികാരം ഉപയോഗിച്ച് വീണ്ടും വീസ റദ്ദാക്കിയത്. ഇതോടെ ജോക്കോവിച്ച് ഉടൻ ഓസ്ട്രേലിയ വിടേണ്ടിവരും. മാത്രമല്ല, മൂന്നു വർഷത്തേക്ക് താരത്തിന് ഓസ്ട്രേലിയയിൽ കാലുകുത്താനും കഴിയില്ല.

അതേസമയം, ഓസീസ് സർക്കാരിൻ്റെ നടപടിക്കെതിരെ ജോക്കോവിച്ച് വീണ്ടും കോടതിയെ സമീപിക്കുമെന്നാണ് ലഭ്യമാകുന്ന വിവരം. ഈ മാസം 17ന് തുടങ്ങുന്ന ടൂർണമെൻ്റിൽ പങ്കെടുക്കുന്നതിന് എത്രയും വേഗം കോടതിയെ സമീപിച്ച് അനുകൂല വിധി സമ്പാദിക്കാനാണ് താരം ശ്രമിക്കുന്നത്. ഓസ്ട്രേലിയൻ ഓപ്പൺ അധികൃതർ ടൂർണമെൻ്റിൽ താരത്തിൻ്റെ പങ്കാളിത്തം ഉറപ്പാക്കി സീഡിങ്ങും മത്സരക്രമവും പ്രഖ്യാപിച്ചതിനു പിന്നാലെയാണ് ഓസ്ട്രേലിയൻ സർക്കാർ ഇമിഗ്രേഷൻ മന്ത്രിയുടെ സവിശേഷാധികാരം ഉപയോഗിച്ച് വീണ്ടും വീസ റദ്ദാക്കിയത്. ഇതോടെ ജോക്കോവിച്ച് ഉടൻ ഓസ്ട്രേലിയ വിടേണ്ടിവരും. മാത്രമല്ല, മൂന്നു വർഷത്തേക്ക് താരത്തിന് ഓസ്ട്രേലിയയിൽ കാലുകുത്താനും കഴിയില്ല.

ഓസ്ട്രേലിയൻ ഇമിഗ്രേഷൻ മന്ത്രി അലക്സ് ഹോക് ആണ് ജോക്കോവിച്ചിൻ്റെ വീസ റദ്ദാക്കി അദ്ദേഹത്തെ നാടുകടത്താനുള്ള നിർണായക തീരുമാനം കൈക്കൊണ്ടത്. സെക്ഷൻ 133 സി (3) പ്രകാരമാണ് ജോക്കോവിച്ചിൻ്റെ വീസ റദ്ദാക്കി അദ്ദേഹത്തെ ഓസ്ട്രേലിയയിൽനിന്നും പുറത്താക്കുന്നതെന്ന് മന്ത്രി വ്യക്തമാക്കി. ജോക്കോവിച്ചും ആഭ്യന്തര വകുപ്പും ഓസ്ട്രേലിയൻ അതിർത്തി സേനയും നൽകിയ രേഖകൾ വിശദമായി പരിശോധിച്ച ശേഷമാണ് ഈ തീരുമാനമെന്നും മന്ത്രി വിശദീകരിച്ചു.

സർക്കാർ ഉത്തരവ്

ഓസ്ട്രേലിയൻ കുടിയേറ്റ നിയമത്തിലെ സെക്ഷൻ 133C(3) പ്രകാരം എൻ്റെ സവിശേഷാധികാരം പ്രയോഗിച്ച് നൊവാക് ജോക്കോവിച്ചിൻ്റെ വീസ ഇതിനാൽ റദ്ദാക്കുന്നു. രാജ്യത്തെ ആരോഗ്യ രംഗത്തിനും പൊതുജന താൽപര്യാർഥവുമാണ് ഈ നടപടി. നടപടിക്രമങ്ങളുമായി ബന്ധപ്പെട്ട കാരണങ്ങളാൽ ഇതേ വീസ മുൻപ് റദ്ദാക്കിയ നടപടി മരവിപ്പിച്ച് 2022 ജനുവരി 10ന് ഫെഡറൽ സർക്യൂട്ട് ആൻഡ് ഫാമിലി കോടതി നൽകിയ ഉത്തരവിൻ്റെ തുടർച്ചയായാണ് ഈ തീരുമാനം.

ഓസ്ട്രേലിയൻ ആഭ്യന്തര വകുപ്പും അതിർത്തി സേനയും നൊവാക് ജോക്കോവിച്ച് നൽകിയ രേഖകൾ ശ്രദ്ധാപൂർവം പരിഗണിച്ച ശേഷമാണ് വീസ റദ്ദാക്കാനുള്ള തീരുമാനത്തിലേക്ക് എത്തിചേർന്നത്. ഓസ്‌ട്രേലിയയുടെ അതിർത്തികൾ സംരക്ഷിക്കാൻ മോറിസൺ ഗവൺമെൻ്റ്  പ്രതിജ്ഞാബദ്ധമാണെന്ന കാര്യം ആവർത്തിക്കുന്നു. പ്രത്യേകിച്ചും കോവിഡ് വ്യാപനം ഭീഷണി സൃഷ്ടിക്കുന്ന സാഹചര്യത്തിൽ.

Meanwhile, it is learned that Djokovic will approach the court again against the action of the Australian government. The player is trying to get a favorable verdict by approaching the court as soon as possible to participate in the tournament which starts on the 17th of this month. The visa was revoked by the Australian government after the Australian Open authorities confirmed the player's participation in the tournament and announced the seeding and competition schedule. With this, Djokovic will have to leave Australia soon. Also, the player will not be able to set foot in Australia for three years.

Australian Immigration Minister Alex Hawke has made the crucial decision to revoke Djokovic's visa and deport him. The minister said Djokovic's visa would be revoked and he would be deported from Australia under Section 133C (3). He said the decision was made after a detailed review of documents provided by Djokovic, the Interior Ministry and the Australian Border Guard.
