അഹമ്മദാബാദ് സ്ഫോടന പരമ്പര - മൂന്നു മലയാളികൾ ഉൾപ്പെടെ 38 പേർക്ക് വധശിക്ഷ

ഗുജറാത്തിലെ അഹമ്മദാബാദ് സ്ഫോടനപരമ്പരക്കേസിൽ മൂന്നു മലയാളികൾ ഉൾപ്പെടെ 38 പ്രതികൾക്ക് പ്രത്യേക കോടതി വധശിക്ഷ വിധിച്ചു. സഹോദരങ്ങളായ കോട്ടയം ഈരാറ്റുപേട്ട പീടിയേക്കൽ ഷിബിലി (41), ഷാദുലി (38), മലപ്പുറം പെരുവള്ളൂർ കരുവാങ്കല്ല് എടപ്പനത്തൊടിക ഷറഫുദ്ദീൻ (44) എന്നിവരാണു വധശിക്ഷയ്ക്ക് വിധിക്കപ്പെട്ട മലയാളികൾ. 

കേസിലെ 78 പ്രതികളും ഇന്ത്യൻ മുജാഹിദ്ദീൻ പ്രവർത്തകരാണെന്നാണു പൊലീസ് ആരോപിച്ചത്. ഇവരിൽ 49 പേരെയാണ് കോടതി ഈ മാസം 8നു കുറ്റക്കാരെന്നു വിധിച്ചത്. പ്രതിചേർക്കപ്പെട്ടവരിൽ 28 പേരെ കോടതി വെറുതെ വിട്ടു. പ്രതികളിൽ ഒരാൾ മാപ്പുസാക്ഷിയായി. 11 പ്രതികൾക്ക് ജഡ്ജി എ ആർ പട്ടേൽ ജീവപര്യന്തം തടവുശിക്ഷയും വിധിച്ചു. രാജ്യത്ത് ആദ്യമായാണ് ഒരു കേസിൽ ഇത്രയും പേർ‍ക്കു വധശിക്ഷ ലഭിക്കുന്നത്. രാജീവ് ഗാന്ധി വധക്കേസിൽ 1998ൽ  26 പ്രതികൾക്കു ടാഡാ കോടതി വധശിക്ഷ വിധിച്ചിരുന്നു. 

ആശുപത്രികൾ ഉൾപ്പെടെ അഹമ്മദാബാദിലെ വിവിധ സ്ഥലങ്ങളിൽ 2008 ജൂലൈ 26നു നടന്ന 22 സ്ഫോടനങ്ങളിൽ 56 പേർ കൊല്ലപ്പെടുകയും 200 ലേറെപ്പേർക്കു പരുക്കേൽക്കുകയും ചെയ്ത കേസിലാണ് ഇപ്പോഴത്തെ ശിക്ഷാവിധി. വധശിക്ഷ ലഭിച്ച 38 പേർക്കുമെതിരെ, ഇന്ത്യൻ ശിക്ഷാ നിയമത്തിലെ (IPC) കൊലപാതകം, കുറ്റകരമായ ഗൂഢാലോചന എന്നീ വകുപ്പുകളും, അവയുടെ അനുബന്ധ വകുപ്പുകളും, നിയമവിരുദ്ധ പ്രവർത്തന നിരോധന നിയമത്തിലെ (UAPA) വിവിധ വകുപ്പുകളുമാണു ചുമത്തിയിരിക്കുന്നത്. ഇവർക്കു വധശിക്ഷയ്ക്ക് മുൻപ് ജീവപര്യന്തം തടവും അനുഭവിക്കണം. ജീവപര്യന്തം തടവുശിക്ഷ മാത്രം ലഭിച്ച 11 പേരുടെ മേൽ ക്രിമിനൽ ഗൂഢാലോചന സംബന്ധിച്ച വകുപ്പുകളും യുഎപിഎ വകുപ്പുകളും ചുമത്തിയതിൻ പ്രകാരമാണു ശിക്ഷ. വധശിക്ഷ ലഭിച്ചവരിൽ ഒരാൾക്ക് ആയുധ നിയമത്തിലെ വകുപ്പുകൾ പ്രകാരവും ശിക്ഷയുണ്ട്. ഇയാൾ 2.88 ലക്ഷം രൂപയും മറ്റു 48 പേർ 2.85 ലക്ഷം രൂപ വീതവും പിഴ നൽകണം.

കൊല്ലപ്പെട്ടവരുടെ കുടുംബങ്ങൾക്ക് ഒരു ലക്ഷം രൂപ വീതവും ഗുരുതര പരുക്കേറ്റവർക്ക് 50,000 രൂപ വീതവും നിസാര പരുക്കുള്ളവർക്ക് 25,000 രൂപ വീതവും നഷ്ടപരിഹാരം നൽകാനും കോടതി വിധിച്ചു. പ്രതികളിൽനിന്ന് ഈടാക്കുന്ന പിഴത്തുക നഷ്ടപരിഹാരം നൽകാൻ വിനിയോഗിക്കാം. കേസിൽ  ശിക്ഷിക്കപ്പെട്ടവർ സബർമതി, മുംബൈ തലോജ, ഡൽഹി തിഹാർ, ഭോപാൽ, ബെംഗളൂരു എന്നിവയുൾപ്പെടെ രാജ്യത്തെ 8  വിവിധ ജയിലുകളിലാണുള്ളത്. ഷിബിലിയും ഷാദുലിയും ഭോപാലിലെ അതീവസുരക്ഷാ ജയിലിലും ഷറഫുദ്ദീൻ ബെംഗളൂരു പാരപ്പന അഗ്രഹാര ജയിലിലുമാണ്. പ്രതികൾ എല്ലാവരും വിഡിയോ കോൺഫറസിങ്ങിലൂടെ വിധി പ്രസ്താവം കേട്ടു. കേസിൽ പിന്നീട് അറസ്റ്റിലായ ഇന്ത്യൻ മുജാഹിദീൻ നേതാവ് യാസീൻ ഭട്കൽ ഉൾപ്പെടെ 4 പ്രതികളുടെ വിചാരണ ഇതുവരെ തുടങ്ങിയിട്ടില്ല.‌

കേസിൽ അഭിഭാഷകരുമായി ആലോചിച്ചശേഷം അപ്പീൽ നൽകുമെന്ന് ഷിബിലിയുടെയും ഷാദുലിയുടെയും പിതാവ് ഈരാറ്റുപേട്ട പീടിയേക്കൽ വീട്ടിൽ പി എസ് അബ്ദുൽ ക‌രീം അറിയിച്ചു. ഇരുവരും നിരപരാധികളാണെന്നു വിശ്വസിക്കുന്നതായും അദ്ദേഹം പറഞ്ഞു.

A special court has sentenced 38 people, including three Malayalees, to death in the Ahmedabad blasts case in Gujarat. The convicts are Shibili (41), Shaduli (38) and Edappanathodika Sharafuddin (44) of Peruvallur, Malappuram. The police alleged that all the 78 accused in the case were Indian Mujahideen activists. Of these, 49 were convicted by a court on the 8th of this month. The court acquitted 28 of the accused. One of the defendants apologized. Judge AR Patel also sentenced 11 accused to life imprisonment. This is the first time in the country that so many people have been sentenced to death in a single case. In 1998, a TADA court sentenced 26 people to death in the Rajiv Gandhi assassination case.

The current verdict comes in the wake of 22 blasts on July 26, 2008 in various places in Ahmedabad, including hospitals, in which 56 people were killed and more than 200 were injured. The 38 convicts have been charged under sections of the Indian Penal Code (IPC) for murder and criminal conspiracy, as well as their related provisions and various sections of the Prohibition of Unlawful Activities Act (UAPA). They face up to life in prison before being executed. The 11 convicts were sentenced to life imprisonment by the Criminal Conspiracy and UAPA departments. One of those sentenced to death is also punishable under the provisions of the Arms Act. He was fined Rs 2.88 lakh and the other 48 were fined Rs 2.85 lakh each.

The court also awarded Rs 1 lakh each to the families of those killed, Rs 50,000 each to those seriously injured and Rs 25,000 each to those with minor injuries. The fine levied on the accused can be used to pay compensation. The convicts are lodged in eight different jails across the country, including Sabarmati, Mumbai Taloja, Delhi Tihar, Bhopal and Bengaluru. Shibili and Shaduli are lodged in the Bhopal High Security Jail and Sharafuddin is lodged in the Bangalore Parappana Agrahara Jail. All the accused listened to the verdict through video conferencing. The trial of four accused, including Indian Mujahideen leader Yasin Bhatkal, who was later arrested in the case, has not yet begun. Shibili and Shaduli's father PS Abdul Kareem said the appeal would be filed after consulting the lawyers in the case at the Erattupetta torture house. He said he believed both were innocent.
