മുല്ലപ്പെരിയാര്‍ - ഡാം സുരക്ഷാ അതോറിറ്റിയുടെ അധികാരം മേല്‍നോട്ടസമിതിക്ക് കൈമാറുമെന്ന് സുപ്രീംകോടതി

മുല്ലപ്പെരിയാര്‍ വിഷയത്തിൽ ദേശീയ ഡാം സുരക്ഷാ അതോറിറ്റിയുടെ നിയമപരമായ അധികാരങ്ങള്‍ താത്കാലികമായി മേല്‍നോട്ട സമിതിക്ക് കൈമാറി ഉത്തരവിറക്കുമെന്ന് സുപ്രീം കോടതി. സാങ്കേതിക വിദഗ്ദ്ധരെ കൂടി ഉള്‍പ്പെടുത്തി മേല്‍നോട്ട സമിതി ശക്തിപ്പെടുത്തുമെന്നും കോടതി പറഞ്ഞു. മേല്‍നോട്ട സമിതി പുനഃക്രമീകരിച്ചുകൊണ്ടുള്ള ഉത്തരവ് വ്യാഴാഴ്ച്ച പുറത്തിറക്കുമെന്നും സുപ്രീം കോടതി വ്യക്തമാക്കി. മുല്ലപ്പെരിയാറുമായി ബന്ധപ്പെട്ട വിഷയങ്ങള്‍ ഡാം സുരക്ഷാ നിയമ പ്രകാരം രൂപീകൃതമായ ദേശീയ ഡാം സുരക്ഷാ അതോറിറ്റിക്ക് കൈമാറണമെന്ന് കേന്ദ്ര സര്‍ക്കാര്‍ കഴിഞ്ഞയാഴ്ച്ച കോടതിയില്‍ ആവശ്യപ്പെട്ടിരുന്നു. എന്നാല്‍, അതോറിറ്റി പൂര്‍ണ്ണ തോതില്‍ പ്രവര്‍ത്തനസജ്ജമാക്കാന്‍ ഇനിയും ഒരു വർഷംകൂടി സമയം ആവശ്യമാണെന്ന് കേന്ദ്ര സര്‍ക്കാര്‍ കോടതിയെ അറിയിച്ചു. ഇതിൻ്റെ അടിസ്ഥാനത്തിൽ, ദേശീയ ഡാം സുരക്ഷാ അതോറിറ്റിയുടെ അധികാരം അതുവരെ മേല്‍നോട്ട സമിതിക്ക് കൈമാറണമെന്നും കേന്ദ്രം ആവശ്യപ്പെട്ടു. തുടര്‍ന്നാണ് അതോറിറ്റിയില്‍ നിക്ഷിപ്തമായ നിയമപരമായ അധികാരങ്ങള്‍ താത്കാലികമായി മേല്‍നോട്ട സമിതിക്ക് കൈമാറി ഉത്തരവിറക്കാന്‍ സുപ്രീം കോടതി തീരുമാനിച്ചത്.

കോടതിയുടെ തീരുമാനത്തെ കേന്ദ്ര സര്‍ക്കാര്‍ പിന്തുണച്ചു. മേല്‍നോട്ട സമിതിയില്‍ രണ്ട് സാങ്കേതിക വിദഗ്ദ്ധരേക്കൂടി ഉള്‍പ്പെടുത്തി സമിതി  ശക്തിപ്പെടുത്തണമെന്ന കേന്ദ്ര സര്‍ക്കാരിൻ്റെ ആവശ്യവും കോടതി തത്വത്തില്‍ അംഗീകരിച്ചു. കേരളത്തിൻ്റെയും തമിഴ്‌നാടിൻ്റെയും ചീഫ് സെക്രട്ടറിമാർ ഓരോ സാങ്കേതിക വിദഗ്ധരെ സമിതിയിലേക്ക് നോമിനേറ്റ് ചെയ്യണമെന്നും കേന്ദ്രം വ്യക്തമാക്കി. മേല്‍നോട്ടസമിതി അധികാരങ്ങള്‍ ഇല്ലാത്ത സമിതിയെന്നാണ് സംസ്ഥാനങ്ങള്‍ കോടതിയില്‍ നടന്ന വാദത്തിനിടയില്‍ വിശേഷിപ്പിച്ചിരുന്നത്. ഡാം സേഫ്റ്റി അതോറിറ്റിയുടെ അധികാരം കോടതി ഉത്തരവിലൂടെ വന്നുചേരുന്നതോടെ മുല്ലപ്പെരിയാര്‍ മേല്‍നോട്ട സമിതി കൂടുതല്‍ ശക്തമാവുകയാണ്. അണക്കെട്ടിൻ്റെ പരിപാലനം, സുരക്ഷ, അറ്റകുറ്റപ്പണികള്‍ തുടങ്ങിയ കാര്യങ്ങളിലൊക്കെ തീരുമാനങ്ങളെടുക്കാനുള്ള അധികാരം സമിതിക്ക് ഉണ്ടാവും.

ഇതോടെ മേല്‍നോട്ട സമിതി നല്‍കുന്ന നിര്‍ദേശങ്ങലും ഉത്തരവുകളും പാലിക്കാന്‍ നിയമപരമായി കേരളത്തിനും തമിഴ്‌നാടിനും ബാധ്യത ഉണ്ടായിരിക്കും. മേല്‍നോട്ട സമിതി ശക്തിപ്പെടുത്തണമെന്ന് കേരളവും ഹർജിക്കാരനായ ഡോ ജോ ജോസഫും സുപ്രീം കോടതിയോട് മുൻപ് തന്നെ  ആവശ്യപ്പെട്ടിരുന്നു.

The Supreme Court has said that the legal powers of the National Dam Safety Authority will be temporarily transferred to the oversight committee in the Mullaperiyar case. The court said the oversight committee would be strengthened by including technical experts. The apex court said on Thursday that it would issue an order restructuring the oversight committee. Last week, the Center had asked the court to refer the Mullaperiyar issue to the National Dam Safety Authority, which was set up under the Dam Safety Act. However, the central government told the court that it needed one more year to make the authority fully operational. Based on this, the Center also demanded that the powers of the National Dam Safety Authority be transferred to the oversight committee till then. The Supreme Court then decided to temporarily transfer the legal powers vested in the Authority to the Oversight Committee.

The Central Government supported the decision of the court. The court also agreed in principle to the central government's demand that the oversight committee be strengthened by including two technical experts. The Center also said that the Chief Secretaries of Kerala and Tamil Nadu should nominate each technical expert to the committee. The states were described in court as having no powers overseeing the oversight body. The Mullaperiyar Oversight Committee is getting stronger with the transfer of power of the Dam Safety Authority through a court order. The committee will have the power to make decisions on the maintenance, safety and maintenance of the dam.

With this, Kerala and Tamil Nadu will be legally bound to follow the directions and orders given by the oversight committee. Kerala and petitioner Dr Joe Joseph had earlier asked the Supreme Court to strengthen the oversight committee.
