കിഫ്‌ബി കേസിൽ ഇ ഡിയ്ക്ക് അടിതെറ്റുന്നു - ഡോ.തോമസ് ഐസക്

കിഫ്ബി കേസിൽ സർവ്വശക്തരായ ED-യ്ക്ക്  അടി തെറ്റുകയാണ്. മസാല ബോണ്ട്  നിയമ വിരുദ്ധമാണ് എന്നു പറഞ്ഞാണല്ലോ ഈ ധനകാര്യ സ്ഥാപനത്തെ ഞെരുക്കി ഇല്ലാതാക്കാൻ കേന്ദ്ര അന്വേഷണ ഏജൻസികൾ തുനിഞ്ഞിറങ്ങിയത്. കഴിഞ്ഞ 2 കൊല്ലമായി കിഫ്ബിയുടെ വിശ്വാസ്യത ഇല്ലാതാക്കാനാണ് ഈ ഏജൻസികൾ ശ്രമിക്കുന്നത്. ആദ്യം ഓഡിറ്റ് സംബന്ധിച്ച വിവാദം. പിന്നെയാണ് ആദായ നികുതിക്കാർ വന്നത്. 

ഇന്ന് ബിബിസി റെയ്ഡ് കാണുമ്പോൾ എനിക്ക് ഓർമ്മവന്നത് കിഫ്ബി റെയ്ഡ് ചെയ്യാൻവന്ന ആദായനികുതിക്കാരെയാണ്. കിഫ്ബിയുടെ കരാറുകാരിൽ നിന്ന് സ്രോതസിൽ നികുതി പിടിച്ചില്ലായെന്നതാണ് ആരോപണം. കരാറുകാരുമായിട്ടുള്ള ബന്ധം അവരെ നിയോഗിച്ച എസ്.പി.വികൾക്കാണ്. എസ്.പി.വികൾക്കു പണം കൈമാറുമ്പോൾ ആദായനികുതി തുക കൃത്യമായി ബില്ലിൽ കാണിച്ചുകൊണ്ടാണ് പണം കൈമാറിയിട്ടുള്ളത്. ഇതെല്ലാം ഓൺലൈനായിട്ടാണ് ചെയ്യുക. അതുകൊണ്ട് പാസ് വേർഡ് തന്നേക്കാം. നിങ്ങളുടെ ഓഫീസിൽ ഇരുന്നു പരിശോധിച്ചാൽ പോരേ. പോരാ. കിഫ്ബി ഓഫീസിൽ ഇരുന്നുതന്നെ പരിശോധിക്കണം. അങ്ങനെയാണ് സംസ്ഥാന മേധാവിയുടെ നേതൃത്വത്തിൽ 15 അംഗ സംഘം ഒരു ദിവസം മുഴുവൻ മാധ്യമ പ്രവർത്തകരെ മുഴുവൻ മുൾമുനയിൽ നിർത്തി കിഫ്ബി ഓഫീസ് പരിശോധിച്ചത്.

ഇതുംകഴിഞ്ഞാണ് ഒടുവിൽ കേന്ദ്രം വജ്രായുധം ഇറക്കിയത്. ED എന്ന കുപ്രസിദ്ധ അന്വേഷണ ഏജൻസിയെ ഇറക്കി കിഫ്ബിയെ പൂട്ടാനുള്ള ശ്രമം. ഉദ്യോഗസ്ഥരെ നിരന്തരം സമ്മർദ്ദത്തിലാക്കുക,  ഒരേ രേഖകൾ  വീണ്ടും വീണ്ടും ആവശ്യപ്പെടുക, അന്വേഷണം എന്ന പേരിൽ സംശയ നിഴൽ നിരന്തരം നിലനിർത്തുക എന്ന  തീർത്തൂം ഗൂഡമായ ശ്രമം. ഇതിങ്ങനെ  അനന്തമായി നീട്ടിക്കൊണ്ട് പോകുന്നു എന്ന അവസ്ഥയിലാണ് കേരള ഹൈക്കോടതിയെ സമീപിക്കുന്നത്. 

ED-യുടേത് രാഷ്ട്രീയക്കളിയാണ് എന്നു തെളിയിക്കുന്നതായിരുന്നു എനിക്കെതിരെയുള്ള സമൻസ്. മന്ത്രിയായിരുന്ന കാലത്ത് ഔദ്യോഗിക പദവിയുടെ ഭാഗമായി കിഫ്ബി വൈസ് ചേയർമാനായിരുന്ന ഞാൻ സകലമാന കണക്കും കൊണ്ടു ചെല്ലാനായിരുന്നു ഇവരുടെ ഉത്തരവ്. പിന്നീട് അത് മാറ്റി മറ്റൊന്ന് തന്നു. കുടുംബാംഗങ്ങളുടെയും മന്ത്രിയായിരിക്കെ  ഡയറക്ടർ ആയ കമ്പനികളുടെ കണക്കുകളും മറ്റും കൊണ്ടു ചെല്ലണം.  കിഫ്ബിയും  ഹൈക്കോടതിയെ സമീപിച്ചു. 

കോടതി സമൻസ്  തുടർ നടപടികൾ സ്റ്റേ ചെയ്തു. മറുപടി സമർപ്പിക്കാൻ  തന്നെ മാസങ്ങൾ വേണ്ടി വന്നു. ഒടുക്കം കോടതി ഒന്നു കടുപ്പിച്ചപ്പോൾ മറുപടി കൊടുത്തു. മസാലബോണ്ട്  പണം നിഷിദ്ധമായ മേഖലകളിൽ മുടക്കുന്നുണ്ട് എന്നതായി അന്വേഷണ വിഷയം.  അപ്പോൾ ഞങ്ങൾ പറഞ്ഞു, ആർബിഐ  നിഷ്ക്കർഷിക്കുന്ന പ്രതിമാസ സ്റ്റേറ്റ്മെന്റ്  കൃത്യമായി കൊടുക്കുന്നുണ്ട്. അതിന്റെ  ED-യ്ക്കും നേരത്തെ കൊടുത്തിട്ടുണ്ട്. 

മസാല ബോണ്ട് പണം ആർക്ക്, എന്തിന് കൊടുത്തു, ഏതു ബാങ്ക് അക്കൌണ്ടിൽ നിന്നും ആരുടെ ബാങ്ക്  അക്കൌണ്ടിലേക്കു നല്കി,  ഇതെല്ലാമുള്ള  നിശ്ചിത ഫോറത്തിലുള്ള,  ആർബിഐ  നിഷ്ക്കർഷിക്കും വിധം സാക്ഷ്യപ്പെടുത്തിയ  സ്റ്റേറ്റ്മെന്റ് ആണ് കൊടുക്കുന്നത്. ഒരു തർക്കവും ആരും പറഞ്ഞിട്ടില്ല. ഇനി ഇതു തന്നെ EDയ്ക്കും കൊടുത്തല്ലോ? അവർ എന്തെങ്കിലും കണ്ടു പിടിച്ചോ? ഇല്ല. വീണ്ടും അതു കോടതിയിലും സമർപ്പിച്ചു. ഈ ഘട്ടത്തിലാണ് കോടതി ആർബിഐ യെ സ്വമേധയാ കക്ഷി ചേർത്തത്. മാസം മൂന്നു നാലായി. ഇപ്പോഴാണ് സത്യവാങ്മൂലം വന്നത്. 

രണ്ടു  കാര്യങ്ങൾ  വ്യക്തമായി. ഒന്ന്, കിഫ്ബി ആർബിഐ ചട്ട പ്രകാരം നല്കിയ എൻഓസി അനുസരിച്ചാണ് മസാലബോണ്ട് വഴി പണം സമാഹരിച്ചത്. അതിനു ലോൺ രജിസ്ട്രേഷൻ നമ്പർ അനുവദിക്കുകയും ചെയ്തിട്ടുണ്ട്. 

രണ്ടാമത്തെ കാര്യം മുകളിൽ പറഞ്ഞ സ്റ്റേറ്റ്മെന്റ് സംബന്ധിച്ചാണ്. ECB-2 എന്ന ഫോമിൽ മസാല ബോണ്ട് വഴി സമാഹരിച്ച പണത്തിന്റെ വിനിയോഗം സംബന്ധിച്ച കണക്കുകൾ കൃത്യമായി നൽകുന്നുണ്ട് എന്ന് ആർബിഐ വ്യക്തമാക്കി.    മസാല  ബോണ്ട്  ഇറക്കുന്ന സമയത്തെ വിദേശ വാണിജ്യ വായ്പ്പ നടപടിക്രമം അനുസരിച്ച് ഈ പണത്തിന്റെ വിനിയോഗം ചട്ടം പാലിച്ചാണോ എന്നതടക്കം ബന്ധപ്പെട്ട ബാങ്ക് സാക്ഷ്യപ്പെടുത്തിയ സ്റ്റേറ്റ്മെന്റാണ്  ECB-2.

അപ്പോൾ ആർബിഐ  കാര്യം വ്യക്തമാക്കിയിരിക്കുന്നു. ഇനി എന്താണ് ED-യുടെ നീക്കം എന്നു നോക്കാം. കോടതി ഒരു സുപ്രധാന കാര്യം ED-യോടു ചോദിച്ചിരുന്നു. മസാല ബോണ്ട് ഇറക്കി രാജ്യത്ത് മറ്റേതെങ്കിലും  സ്ഥാപനം വായ്പ്പ എടുത്തിട്ടുണ്ടോ? അവരെക്കുറിച്ച്  നിങ്ങൾ  എന്തെങ്കിലും അന്വേഷണം  നടത്തുന്നുണ്ടോ? പലവട്ടം കോടതി ചോദിച്ചിട്ടും മിണ്ടിയിട്ടില്ല. അത് പറയുക തന്നെ വേണം എന്നു കോടതി പറഞ്ഞിട്ടുമുണ്ട്. എന്താണ് പറയുക എന്നു നോക്കാം.

അപ്പോൾ പലയിടത്തും നടത്തുന്ന പയറ്റ് അത്ര ഫലിക്കില്ല, ഇവിടെ ആരും അങ്ങനെ  കുനിഞ്ഞു തരില്ല എന്നതു ED മനസിലാക്കട്ടെ എന്ന് കേരളത്തിൻ്റെ മുൻ ധനകാര്യ മന്ത്രിയും സാമ്പത്തിക വിദഗ്ധനുമായ തോമസ് ഐസക് ഫേസ്ബുക്കിൽ കുറിച്ചു.

In KIIFB case, almighty ED is wrong. Central investigation agencies tried to suppress and destroy this financial institution saying that masala bond is illegal. These agencies have been trying to destroy the credibility of KIIFB for the last 2 years. First the audit controversy. Then came the Income Tax.

Watching the BBC raid today, I was reminded of the income tax people who came to raid KIIFB. It is alleged that tax was not collected at source from KIIFB's contractors. The relationship with the contractors is with the SPVs that appointed them. When money is transferred to SPVs, the amount of income tax is shown in the bill. All this is done online. So you can give the password. It is not enough to sit in your office and check. not enough KIIFB should check sitting in the office. That is how a 15-member team led by the head of the state inspected the KIIFB office for a whole day keeping all the media workers at bay.

It was only after this that the Center finally launched the diamond weapon. An attempt to lock up Kifbi by bringing down the infamous investigative agency ED. A very insidious attempt to constantly pressurize officials, ask for the same documents again and again, and constantly maintain the shadow of suspicion in the name of investigation. The Kerala High Court is being approached in a situation where this is going on endlessly.

The summons against me proved that the ED is a political game. Their order was that I, who was the vice-chairman of KIIFB as part of my official position during my tenure as a minister, should go with all due respect. Later it was changed and another one was given. Accounts of family members and companies where he was a director while he was a minister should be taken with him. KIIFB also approached the High Court.

The court summons stayed further proceedings. It took months to submit the reply. Finally, when the court insisted, he answered. The subject of investigation is that Masalabond money is being spent in prohibited areas. So we said, RBI is providing the monthly statement correctly. Its ED has also been given earlier.

Masala bond money is given to whom and for what purpose, from which bank account to which bank account, all this in the prescribed form, certified by RBI impartially. No one argued. Now this is also given to ED? Did they discover something? no Again it was submitted to the court. It was at this stage that the court made RBI a voluntary party. The month turned into three and four. Just now the affidavit came.

Two things became clear. First, KIIFB has raised money through Masalabond as per NOC issued by RBI. A loan registration number has also been allotted to it.

The second point is regarding the above statement. The RBI has clarified that the figures regarding the utilization of the money raised through masala bonds are being given accurately in Form ECB-2. ECB-2 is a statement certified by the concerned bank including compliance of the utilization of this money as per foreign commercial credit procedure at the time of issue of masala bond.

Then RBI has clarified the matter. Now let's see what the move of ED. The court asked the ED an important matter. Has any other institution in the country taken loan by issuing masala bond? Are you doing any research on them? Despite asking the court several times, the court did not speak. The court has said that it should be said. Let's see what to say.
