ജഡ്ജി നിയമനത്തിൽ കടുത്ത നടപടി എടുപ്പിക്കരുതെന്ന് സർക്കാരിനോട് സുപ്രിം കോടതി.

വിവിധ  ഹൈക്കോടതികളിലെ 5 ജഡ്ജിമാർക്കു സുപ്രീം കോടതി ജഡ്ജിമാരായി സ്ഥാനക്കയറ്റം നൽകുന്ന കാര്യത്തിൽ അനാവശ്യ കാലതാമസം ഉണ്ടാവുന്നതിനെതിരെ കടുത്ത വിമർശനവുമായി സുപ്രിം കോടതി. വിഷയം പരിഗണിക്കവെ കേന്ദ്ര സർക്കാരിനെതിരെയാണ് ജസ്റ്റിസ് സഞ്ജയ് കിഷൻ കൗൾ കടുത്ത ഭാഷയിൽ വിമർശിച്ചത്.  ജഡ്ജി നിയമനത്തിൽ തീർപ്പുണ്ടായില്ലെന്നതിനു പുറമേ, കേസ് പരിഗണിക്കുന്നതു വീണ്ടും മാറ്റിവയ്ക്കണമെന്നു കേന്ദ്രം ആവശ്യപ്പെട്ടതാണ് ജസ്റ്റിസ് സഞ്ജയ് കിഷൻ കൗളിനെ ചൊടിപ്പിച്ചത്. കടുത്ത നടപടികൾ എടുപ്പിക്കരുതെന്നും അതു കേന്ദ്ര സർക്കാരിനു രുചിക്കണമെന്നില്ലെന്നും ജസ്റ്റിസ് കൗൾ പറഞ്ഞു.

‘സ്ഥലംമാറ്റ ഉത്തരവിൽ സർക്കാർ തീരുമാനമെടുക്കാത്തതു ഞങ്ങളെ ബുദ്ധിമുട്ടിക്കുന്നുണ്ട്. പുതിയ ജഡ്ജിമാരെ നിയമിക്കുന്ന കാര്യത്തിൽ സർക്കാരിന് പലതും പറയാനുണ്ടാകുമെന്നറിയാം. എന്നാൽ, സ്ഥലംമാറ്റ കാര്യം അങ്ങനെയല്ല. ഇക്കാര്യത്തിൽ മൂന്നാമതൊരു കക്ഷിയുടെ ഇടപെടൽ കോടതി അനുവദിക്കില്ല.’– ജസ്റ്റിസ് കൗൾ പറഞ്ഞു.

ജഡ്ജി നിയമനത്തിനു പുറമേ, ജഡ്ജിമാരുടെ സ്ഥാനക്കയറ്റവും വൈകിപ്പിക്കുന്ന കേന്ദ്ര സർക്കാർ നടപടി തുടർന്നാൽ കടുത്ത നടപടികളുണ്ടാകുമെന്നു സുപ്രീം കോടതി താക്കീതു ചെയ്തു. കഴിഞ്ഞതവണ വിഷയം പരിഗണിച്ചപ്പോഴും സർക്കാരിനു കോടതി മുന്നറിയിപ്പു നൽകിയിരുന്നതാണ്. 

വിമര്ശനങ്ങൾക്കിടയിൽ, നാളെയ്ക്കുളളിൽ വിജ്ഞാപനമിറക്കുമെന്നു കേന്ദ്ര സർക്കാർ ഉറപ്പു നൽകി. കൊളീജിയം നൽകിയ ശുപാർശകൾ വൈകുന്നതുമായി ബന്ധപ്പെട്ട് കോടതി ഉന്നയിച്ച ചോദ്യങ്ങൾക്കു മറുപടിയായാണു വിജ്ഞാപനം വൈകില്ലെന്ന് അറ്റോർണി ജനറൽ ആർ. വെങ്കിട്ടരമണി വ്യക്തമാക്കിയത്. 

ഡിസംബറിൽ നൽകിയ 5 ജഡ്ജിമാരുടെ കാര്യം ഓർമിപ്പിച്ച കോടതി, ഇതു ഫെബ്രുവരിയായെന്നും പറഞ്ഞു. തുടർന്നാണ് രാഷ്ട്രപതിയുടെ അനുമതിക്കായി വിജ്ഞാപനം നൽകിയെന്നും നടപടി വൈകില്ലെന്നും എജി അറിയിച്ചത്. ഹർജി 13നു പരിഗണിക്കാനായി മാറ്റി. ജഡ്ജിമാരുടെ സ്ഥലംമാറ്റവുമായി ബന്ധപ്പെട്ടു ഗുജറാത്ത്, തെലങ്കാന, മദ്രാസ് ഹൈക്കോടതികളി‍ൽ അഭിഭാഷകർ പ്രതിഷേധം നടത്തുന്ന കാര്യവും കോടതി ഓർമിപ്പിച്ചു.

The Supreme Court strongly criticized the unnecessary delay in the promotion of 5 judges of various high courts as Supreme Court judges. While considering the matter, Justice Sanjay Kishan Kaul criticized the central government in harsh language. Justice Sanjay Kishan Kaul was irked by the Centre's request for another adjournment of the case, apart from the impasse on the appointment of the judge. Justice Kaul said that harsh measures should not be taken, and the central government should not taste it.

"The fact that the government has not taken a decision on the relocation order is troubling us. It is known that the government has a lot to say when it comes to appointing new judges. However, this is not the case with relocation. The court will not allow the intervention of a third party in this regard.'- Justice Kaul said.

Apart from the appointment of judges, the Supreme Court has also warned of severe action if the central government's action of delaying the promotion of judges continues. Even when the matter was considered last time, the court had warned the government.

Amid criticism, the central government has promised to issue a notification by tomorrow. In response to the questions raised by the court regarding the delay in the recommendations given by the collegium, Attorney General R. Venkataramani clarified.
