സര്‍ക്കാരിന് തിരിച്ചടി. ഇ ഡിക്കെതിരായ ജുഡീഷ്യല്‍ അന്വേഷണത്തിന് ഇടക്കാല സ്‌റ്റേ

 

സ്വര്‍ണ്ണക്കടത്ത് കേസില്‍ കേന്ദ്ര ഏജന്‍സിക്കെതിരേയുള്ള അന്വേഷണത്തിന് ജുഡീഷ്യല്‍ കമ്മീഷനെ നിയോഗിച്ച സംസ്ഥാന സര്‍ക്കാരിന് തിരിച്ചടി. എന്‍ഫോഴ്‌സ്‌മെന്റ് ഡയറക്ടറേറ്റ് (ഇഡി) ഉദ്യോഗസ്ഥര്‍ക്കെതിരേയുള്ള ജുഡീഷ്യല്‍ അന്വേഷണം സ്‌റ്റേ ചെയ്ത് ഹൈക്കോടതി ഇടക്കാല ഉത്തരവിറക്കി. ജുഡീഷ്യല്‍ കമ്മീഷനെതിരായ ഇഡിയുടെ ഹര്‍ജി നിലനില്‍ക്കില്ലെന്നായിരുന്നു സര്‍ക്കാര്‍ വാദം. എന്നാൽ ഈ വാദം  തള്ളിയാണ് കോടതി ഇടക്കാല ഉത്തരവിറക്കിയത്. റിട്ട. ജസ്റ്റിസ് വി കെ  മോഹനന്‍ അധ്യക്ഷനായ കമ്മീഷനായിരുന്നു ഇ ഡി ക്കെതിരെ ജുഡീഷ്യല്‍ അന്വേഷണം നടത്തിയത്. അന്വേഷണത്തിന്റെ ഭാഗമായി പലര്‍ക്കും കമ്മീഷൻ നോട്ടീസ് അയച്ചിരുന്നു. ഇഡിക്കെതിരായി ജുഡീഷ്യല്‍ കമ്മീഷനെ നിയോഗിച്ച പരാതി കോടതി ഫയലില്‍ സ്വീകരിച്ചിട്ടുണ്ട്. ജുഡീഷ്യല്‍ കമ്മീഷൻ്റെ പ്രവര്‍ത്തനങ്ങള്‍ സ്റ്റേ ചെയ്തിരിക്കുന്നുവെന്നും കോടതി ഇടക്കാല ഉത്തരവില്‍ വ്യക്തമാക്കിയിട്ടുണ്ട്. കേസില്‍ കോടതി വിശദമായ വാദം കേള്‍ക്കും.  

കേസുമായി ബന്ധപ്പെട്ട് എതിര്‍ കക്ഷികളായ അഡീഷണല്‍ ചീഫ് സെക്രട്ടറി, മുഖ്യമന്ത്രി പിണറായി വിജയന്‍, ഡിപ്പാര്‍ട്മെൻ്റ്  ഓഫ് ജനറല്‍ അഡ്മിനിസ്ട്രേഷന്‍ എന്നീ മൂന്ന് പേര്‍ക്കും നോട്ടീസ് അയക്കാനും കോടതി തീരുമാനിച്ചു. സ്വര്‍ണക്കടത്ത് കേസ് നിലനില്‍ക്കുന്നതുവരെ ജുഡീഷ്യല്‍ അന്വേഷണം സ്റ്റേ ചെയ്യണമെന്ന്‌ ഇഡി ആവശ്യപ്പെട്ടിരുന്നു. 1952 ലെ കമ്മീഷന്‍ ഓഫ് എന്‍ക്വയറി ആക്ട് പ്രകാരം ഒരു കേന്ദ്ര ഏജന്‍സിക്കെതിരേ  സംസ്ഥാന സര്‍ക്കാരിന് ഇത്തരത്തിലൊരു കമ്മീഷനെ വെക്കാന്‍ അധികാരമില്ലെന്നും ഈ കമ്മീഷനെ നിശ്ചയിച്ചുകൊണ്ടുള്ള മുഖ്യമന്ത്രിയുടെ നിലപാട് അധികാരദുര്‍വിനിയോഗമാണെന്നുമാണ് ഇഡി കോടതിയില്‍ വാദിച്ചത്‌. കമ്മീഷന് നിയമപരമായി ഒരു സാധുതയും ഇല്ലെന്നും ഇഡി കോടതിയെ അറിയിച്ചു. സ്വര്‍ണക്കടത്ത് കേസ് അട്ടിമറിക്കാനുള്ള ശ്രമമാണ് സര്‍ക്കാരിൻ്റെ ഭാഗത്ത് നിന്ന് ഉണ്ടാകുന്നതെന്നും ഇ ഡി കോടതിയില്‍ വ്യക്തമാക്കി. 

   ശ്രീജേഷിന് രണ്ടു കോടി പാരിതോഷികം

The state government, which appointed a judicial commission to probe the central agency in the gold smuggling case, has hit back. The High Court issued an interim order staying the judicial inquiry against the Enforcement Directorate (ED) officials. The government maintained that the ED's petition against the judicial commission would not stand. But the court issued an interim order rejecting this argument. Retd. The JUDICIAL inquiry against the ED was conducted by the Commission of Justice V K Mohanan. The commission had sent notices to several people as part of the investigation. A complaint appointed by the Judicial Commission against the ED has been received in the court file. The court has also stated in its interim order that the activities of the Judicial Commission have been stayed. The court will hear the case in detail.

The court also decided to send notices to the three opposing parties in the case, Additional Chief Secretary, Chief Minister Pinarayi Vijayan and The Department of General Administration. The ED had demanded a stay of the judicial inquiry till the gold smuggling case is pending. The ED argued in court that under the Commission of Enquiry Act, 1952, the state government had no power to set up such a commission against a central agency and the chief minister's stand on appointing this commission was an abuse of power. The ED also informed the court that the commission had no legal validity. The ED also told the court that an attempt was being made on the part of the government to sabotage the gold smuggling case.
