കണ്ണൂർ വി സി നിയമനം ശരിവെച്ച് ഹൈക്കോടതി

കണ്ണൂർ സർവകലാശാല വൈസ് ചാൻസിലർ നിയമനത്തിൽ, വി സിയുടെ പുനർനിയമനം ശരിവെച്ച് ഹൈക്കോടതി സിംഗിൾ ബഞ്ച്. ഹർജി നിയമപരമായി നിലനിൽക്കുന്നതല്ല എന്നു ചൂണ്ടിക്കാട്ടി ജസ്റ്റിസ് അമിത് റാവലിൻ്റെ സിംഗിൾ ബെഞ്ചിൻ്റെതാണ് നടപടി. വൈസ് ചാൻസലർ ഗോപിനാഥ് രവീന്ദ്രൻ്റെ പുനർ നിയമനം സർക്കാർ സമ്മർദ്ദത്തെ തുടർന്നാണ് എന്നായിരുന്നു ഗവർണർ ആരിഫ് മുഹമ്മദ് ഖാൻ കഴിഞ്ഞ ദിവസം മാധ്യമങ്ങളോട് പരസ്യമായി പറഞ്ഞത്. എന്നാൽ ഗവർണറാണ് വി സിയുടെ  പുനർനിയമനം നടത്തിയത് എന്നായിരുന്നു സർക്കാർ നിലപാട്. ഗവർണർ അറിഞ്ഞ് യു ജി സിയുടെ മാർഗ്ഗനിർദ്ദേശങ്ങളും സർവകലാശാല നിയമവും പാലിച്ചാണ് വി സിയുടെ നിയമനം നടന്നത് എന്ന് കഴിഞ്ഞ ദിവസം കേസ് പരിഗണിക്കുമ്പോൾ ഹൈക്കോടതി നിരീക്ഷിച്ചു. 2017 നവംബർ മുതൽ 2021 നവംബർ 22 വരെ ആയിരുന്നു ഗോപിനാഥിൻ്റെ വൈസ് ചാൻസലർ കാലാവധി. 

കണ്ണൂർ വി സി ഗോപിനാഥിൻ്റെ നിയമനം സർവകലാശാലാ നിയമത്തിനു വിരുദ്ധമാണെന്നും അതിനാൽ തുടർനിയമനം അനുവദിക്കരുതെന്നും ആവശ്യപ്പെട്ട് സർവകലാശാലാ സെനറ്റ് അംഗം ഡോ. പ്രേമചന്ദ്രൻ കീഴോത്ത്, അക്കാദമിക് കൗൺസിൽ അംഗം ഡോ. ഷിനോ പി ജോസ് എന്നിവർ നൽകിയ ഹർജിയാണ് തള്ളിയത്. വൈസ് ചാൻസലറുടെ പ്രായം 60 കടന്നതും നിയമന കാലാവധി നീട്ടി നൽകുകയല്ല, പുനർനിയമനമാണു നടന്നിരിക്കുന്നത് എന്നും നിയമനത്തിൽ യുജിസിയുടെ മാനദണ്ഡങ്ങൾ ലംഘിച്ചെന്നുമായിരുന്നു ഹർജിക്കാർ ഉന്നയിച്ച വാദം. കേരളത്തിന് പുറത്തുള്ള സര്വകലാശകളിൽ പുനർനിയമനം സാധാരണ കാര്യമാണെന്നും അത് യു ജി സി ചട്ടങ്ങൾക്ക് വിരുദ്ധമല്ലെന്നും സർക്കാർ വാദിക്കുന്നു.  

High Court single bench upholds Kannur University Vice Chancellor re-appointment. The action was taken by a single bench of Justice Amit Rawal, saying the petition was not legally binding. Governor Arif Mohammad Khan told the media two days before that the re-appointment of Vice-Chancellor Gopinath Raveendran was due to government pressure. But the government said the VC had been re-appointed by the governor. The High Court had yesterday observed that the appointment of the VC was made in compliance with the UGC guidelines and the University Act, with the knowledge of the Governor. Gopinath's term as Vice-Chancellor was from November 2017 to November 22, 2021.

University Senate member Dr Premachandran Keezhoth and Academic Council member Dr Shino P Jose filed a plea, that the appointment of Kannur VC Gopinath was against university law and therefore should not be allowed for further appointment and the seme is rejected on the no ground. The petitioners contended that the Vice-Chancellor was over 60 years of age and that the appointment was not an extension of tenure but a reappointment and that the appointment violated UGC norms. The Government argues that reappointment is common in universities outside Kerala and is not contrary to UGC rules.
