ലഖിംപുർ ഖേരി സംഭവം ആസൂത്രിതം. ഗൂഢാലോചന നടന്നു - അന്വേഷണ സംഘം

ഉത്തർ പ്രദേശിലെ ലഖിംപുർ ഖേരിയിൽ കർഷർക്കിടയിലേക്കു കേന്ദ്ര സഹമന്ത്രി അരുൺ മിശ്രയുടെ മകൻ്റെ വാഹനം പാ‍ഞ്ഞുകയറി കർഷകർ മരിച്ച സംഭവത്തിൽ, സംഭവം അപകടമല്ലെന്നും ആസൂത്രിതമാണെന്നും ഇതിന് പിന്നിൽ ഗൂഢാലോചന നടന്നിട്ടുണ്ടെന്നും പ്രത്യേക അന്വേഷണ സംഘം. കേസിൽ പ്രതികളായ 13 പേർക്കെതിരെ കൊലക്കുറ്റത്തിനുള്ള വകുപ്പുകൾ കൂടി ചുമത്തണം എന്നാവശ്യപ്പെട്ട് പ്രത്യേക അന്വേഷണ സംഘം ചീഫ് ജുഡിഷ്യൽ മജിസ്ട്രേറ്റ് (സിജിഎം) കോടതിയിൽ അപേക്ഷ നൽകി. 

കേസിലെ പ്രതികൾക്കെതിരെ ഉത്തർപ്രദേശ് പോലീസ് ചുമത്തിയിരിക്കുന്ന വകുപ്പുകളായ ഐപിസി 279, 338, 304എ, എന്നിവയ്ക്കു പകരം പുതിയ വകുപ്പുകൾ ചേർക്കണം എന്നാണ് അന്വേഷണ സംഘം അപേക്ഷയിൽ ആവശ്യപ്പെടുന്നത്. മുൻകൂട്ടി ആസൂത്രണം ചെയ്തു കൃത്യമായി നടപ്പാക്കിയ ക്രൂരകൃത്യമായിരുന്നു ലഖിംപുരിൽ അരങ്ങേറിയതെന്നും അന്വേഷണ ഉദ്യോഗസ്ഥൻ സമർപ്പിച്ച അപേക്ഷയിൽ പറയുന്നു. വധശ്രമം (ഐപിസി 307), ആയുധങ്ങൾ കൊണ്ടോ മറ്റു മാർഗങ്ങളാലോ ബോധപൂർവം മാരകമായി മുറിവ് ഏൽപിക്കൽ  (ഐപിസി 326), കുറ്റകൃത്യത്തിനായി സംഘം ചേർന്നു പ്രവർത്തിക്കൽ (ഐപിസി 34) എന്നീ വകുപ്പുകൾ കുറ്റാരോപിതർക്കെതിരെ ചേർക്കുകയും, പൊതു സ്ഥലത്തുകൂടി അശ്രദ്ധമായി വാഹനം ഓടിക്കൽ (ഐപിസി 279), അറിഞ്ഞോ അറിയാതെയോ വാഹനം ഇടിച്ച് ആളുകളെ ഗുരുതരമായി പരുക്കേൽപിക്കൽ (ഐപിസി 338), മനപ്പൂർവമല്ലാത്ത നരഹത്യ (ഐപിസി 304എ) എന്നീ വകുപ്പുകൾ ഒഴിവാക്കുകയും ചെയ്യണമെന്നാണ്  അപേക്ഷേ.

ഒക്ടോബർ 3നു ലഖിംപുരിൽ നടന്ന മന്ത്രി പുത്രൻ്റെ അതിക്രമത്തിൽ, സമരത്തിൽ പങ്കെടുക്കുകയായിരുന്ന  4 കർഷകർ അടക്കം 8 പേർ മരിച്ചിരുന്നു. കേന്ദ്ര മന്ത്രി അജയ് മിശ്രയുടെ മകൻ ആശിഷ് മിശ്രയുടെ ഉടമസ്ഥതയിലുള്ള വാഹനം ഇടിച്ചാണു കർഷകരുടെ മരണമടഞ്ഞത്. സംഭവത്തിന് ശേഷം ഏറെ സമ്മർദ്ദത്തിനൊടുവിൽ അറസ്റ്റിലായ ആശിഷ് മിശ്ര അടക്കമുള്ളവർ ലഖിംപുർ ഖേരിയിലെ ജില്ലാ ജയിലിലാണ്.അതേ സമയം ആശിഷ് മിശ്രയുടെ ജാമ്യാപേക്ഷയ്ക്കു മറുപടി നൽകാൻ അലഹബാദ് ഹൈക്കോടതിയിലെ ലക്നൗ ബെഞ്ച് സംസ്ഥാന സർക്കാരിനു 4 ദിവസത്തെ സമയം നൽകിയിട്ടുണ്ട്. കേസിൽ വാദം കേൾക്കുന്നതിനിടെ, ഒട്ടേറെ ദൃക്സാക്ഷികളുടെ മൊഴി ഇനിയും രേഖപ്പെടുത്താനുണ്ടെന്നു അഡിഷനിൽ അഡ്വക്കറ്റ് ജനറൽ വിനോദ് ഷാഹി കോടതിയെ അറിയിച്ചിരുന്നു. 

ലഖിംപുർ ഖേരിയിൽ കർഷകരെ കാർ കയറ്റി കൊന്ന കേസ്: ആശിഷ് മിശ്ര അറസ്റ്റിൽ

The Special Investigation Team (SIT) has said that the incident in which Union Minister Arun Mishra's son's vehicle ranned into a group of farmers in Lakhimpur Kheri in Uttar Pradesh and killed the farmers was not accidental and there was a conspiracy behind it. The Special Investigation Team (SIT) has filed an application in the Chief Judicial Magistrate (CGM) court seeking imposition of murder charges against the 13 accused in the case.

The inquiry team has sought the replacement of sections 279, 338 and 304A of the IPC, which are imposed by the Uttar Pradesh Police against the accused in the case. According to the application submitted by the investigating officer, the atrocity that took place in Lakhimpur was a premeditated and well-executed atrocity. Sections include attempted murder (IPC 307), intentional infliction of grievous bodily harm by weapon or other means (IPC 326), and criminal gang-rape (IPC 34), and negligent driving (IPC 279), knowingly or unknowingly driving in public (IPC 279). Sections 338 of the IPC and Section 304A of the Penal Code (IPC 304A) should be omitted.

On October 3, eight people, including four protesting farmers, were killed in an attack on a minister's son in Lakhimpur. A farmer owns a vehicle owned by Ashish Mishra, son of Union Minister Ajay Mishra. The Lucknow bench of the Allahabad High Court has given the state government four days to respond to Ashish Mishra's bail application. During the hearing, Advocate General Vinod Shahi told the court that the statements of several eyewitnesses were yet to be recorded.
