വാട്സാപ് സന്ദേശങ്ങൾക്ക് ഗ്രൂപ്പ് അഡ്മിൻ ഉത്തരവാദിയല്ല - മദ്രാസ് ഹൈക്കോടതി

വാട്‌സാപ്പ് ഗ്രൂപ്പുകളിൽ അംഗങ്ങൾ പോസ്റ്റ് ചെയ്യുന്ന എല്ലാ സന്ദേശങ്ങൾക്കും  അഡ്മിൻ ഉത്തരവാദിയല്ലെന്ന് മദ്രാസ് ഹൈക്കോടതി. മുംബൈ, ഡൽഹി ഹൈക്കോടതികൾ നേരത്തേ സമാന ഉത്തരവു പുറപ്പെടുവിച്ചിരുന്നു. വാട്‌സാപ്പ് ഗ്രൂപ്പുകളിൽ അഡ്മിനു പരിമിതമായ നിയന്ത്രണം മാത്രമേയുള്ളൂവെന്നും അംഗങ്ങളുടെ സന്ദേശങ്ങൾ ആസൂത്രിതമായാണെന്ന് കരുതാനാകില്ലെന്നും ഹൈക്കോടതി പറഞ്ഞു.

ആസൂത്രിതമായാണ് സന്ദേശങ്ങൾ  കൈമാറിയതെന്ന് തെളിയാതെ മറ്റൊരാളുടെ സന്ദേശത്തിൻ്റെ പേരിൽ അഡ്മിനെതിരെ നടപടിയെടുക്കാൻ പാടില്ല. അഭിഭാഷകരുടെ വാട്സാപ്പ് ഗ്രൂപ്പിലെ സന്ദേശത്തിൻ്റെ പേരിൽ അഡ്മിനെതിരെ പൊലീസ് കേസെടുത്തതിനെതിരെയുള്ള ഹർജിയാണു പരിഗണിച്ചത്.

The Madras High Court has ruled that the admin is not responsible for all messages posted by members of WhatsApp groups. The Mumbai and Delhi High Courts had earlier issued similar orders. The High Court ruled that the admin had limited control over WhatsApp groups and that members' messages could not be considered organized.

No action can be taken against the admin for someone else's message unless it is proven that the messages were delivered intentionally. The petition was filed against the police for filing a case against the admin for the message on the lawyers' WhatsApp group.
