ലോകായുക്താ ഓർഡിനൻസ് - മുഖ്യമന്ത്രിയുമായുള്ള കൂടിക്കാഴ്ചയ്ക്ക് പിന്നാലെ ഗവർണർ ഒപ്പിട്ടു

ലോകായുക്താ നിയമഭേദഗതി.ഓർഡിനൻസിൽ ഗവർണർ ആരിഫ് മുഹമ്മദ് ഖാൻ ഒപ്പിട്ടത്തോടെ അംഗീകാരമായി. ഞായറാഴ്ച വൈകുന്നേരം മുഖ്യമന്ത്രി പിണറായി വിജയൻ രാജ്ഭവനിലെത്തി ഗവർണർ ആരിഫ് മുഹമ്മദ് ഖാനുമായി കൂടിക്കാഴ്ച നടത്തിയതിന് പിന്നാലെയാണ് ഓർഡിനൻസിൽ ഗവർണർ ഒപ്പുവെച്ചത്. ഓർഡിനൻസിൽ ഒപ്പ് വെച്ചതോട് കൂടി അടുത്ത നിയമസഭാ സമ്മേളനം ചേരുന്നതുമായി ബന്ധപ്പെട്ട കാര്യത്തിൽ സർക്കാരിന് തീരുമാനം എടുക്കാൻ സാധിക്കും. ഓർഡിനൻസ് ഒപ്പിടാതിരിക്കുന്ന സാഹര്യം ഉണ്ടായിരുന്നുവെങ്കിൽ നിയമസഭ ചേരുന്നതിന് അത് തടസം ആകുമായിരുന്നു.ലോകായുക്തയ്ക് ഭരണഘടനാ വിരുദ്ധമായ ചില അധികാരങ്ങൾ ഉണ്ടെന്ന നിയമോപദേശത്തെ തുടർന്നാണ് സർക്കാർ ഇത്തരം ഒരു ഓർഡിനൻസിലേക്ക് എത്തിയതെന്നും, ഓർഡിനൻസ്  രാഷ്ട്രീയ ലക്ഷ്യം വെച്ചു കൊണ്ടുള്ളതല്ല എന്നും കൂടിക്കാഴ്ചയില്‍ ഗവര്‍ണറെ മുഖ്യമന്ത്രി ബോധ്യപ്പെടുത്തി.

ലോകായുക്തയുടെ വിധി തള്ളാൻ സർക്കാരിന് അധികാരം നൽകുന്ന ഓർഡിനൻസ് സർക്കാർ അയച്ചിട്ട് രണ്ടാഴ്ചയായെങ്കിലും ഗവർണർ ഒപ്പിട്ടിരുന്നില്ല. ഓർഡിനൻസിൻ്റെ സാഹചര്യം വ്യക്തമാക്കണമെന്ന് ആവശ്യപ്പെട്ട് ഗവർണർ വിശദീകരണം ചോദിച്ചിരുന്നു. സർക്കാർ മറുപടിയും നൽകിയിരുന്നു. അമേരിക്കയിലെ ചികിത്സയും ഒമ്പതുദിവസത്തെ യു എ ഇ സന്ദർശനവും കഴിഞ്ഞ് ഞായറാഴ്ച പുലർച്ചെ തിരുവനന്തപുരത്ത് തിരിച്ചെത്തിയ മുഖ്യമന്ത്രി പിണറായി വിജയൻ വൈകുന്നേരം ഗവർണർ ആരിഫ് മുഹമ്മദ് ഖാനെ സന്ദർശിക്കുകയും വിവാദമായ ലോകായുക്ത ഭേദഗതി ഓർഡിനൻസിൽ ഗവർണർ ഒപ്പിടണമെന്ന് അഭ്യർഥിക്കുകയും ചെയ്തിരുന്നു. തുടർന്ന് ഗവർണർ ലോകായുക്ത ഓർഡിനൻസിൽ ഒപ്പു വെക്കുകയായിരുന്നു. അഴിമതിക്കേസിൽ മന്ത്രിമാർ മാറിനിൽക്കണമെന്ന് ലോകായുക്ത വിധിച്ചാൽ, പരിശോധിച്ച് അത് തള്ളാനുള്ള അധികാരം സർക്കാരിന് നൽകുന്നതാണ് പ്രധാന ഭേദഗതി.

The Lokayukta amendment was approved by Governor Arif Mohammad Khan. The ordinance was signed by Chief Minister Pinarayi Vijayan on Sunday evening after a meeting with Governor Arif Mohammad Khan at the Raj Bhavan. With the signing of the ordinance, the government will be able to decide on the next assembly session. During the meeting, the Chief Minister assured the Governor that the ordinance was not aimed at politics and that the government had come up with such an ordinance following legal advice that the Lokayukta had certain powers that were unconstitutional.

Two weeks after the government sent the ordinance empowering the government to overturn the Lokayukta's verdict, the governor had not signed it.
