സി എ എ പ്രക്ഷോഭകരുടെ സ്വത്ത് കണ്ടുകെട്ടുന്നതിനുള്ള നോട്ടീസുകള്‍ പിന്‍വലിച്ചെന്ന് യു പി സര്‍ക്കാര്‍

പൗരത്വ നിയമ ഭേദഗതിക്ക് (CAA) എതിരായ സമരങ്ങളില്‍ പങ്കെടുത്തവരുടെ സ്വത്തുക്കള്‍ കണ്ടുകെട്ടാനുള്ള നോട്ടീസുകള്‍ പിന്‍വലിച്ചതായി ഉത്തര്‍പ്രദേശ് സര്‍ക്കാര്‍ സുപ്രീം കോടതിയെ അറിയിച്ചു. 274 നോട്ടീസുകള്‍ പിന്‍വലിച്ചതായാണ് യു പി സര്‍ക്കാര്‍ സുപ്രീം കോടതിയെ അറിയിച്ചത്. ചട്ടങ്ങള്‍ ലംഘിച്ച് സി എ എ പ്രക്ഷോഭകരുടെ സ്വത്ത് കണ്ടുകെട്ടുന്നതിന്  നോട്ടീസ് നല്‍കിയ ഉത്തര്‍ പ്രദേശ് സര്‍ക്കാരിനെ സുപ്രീം കോടതി നിശിതമായി വിമര്‍ശിച്ചിരുന്നു. പുതുക്കിയ നിയമത്തിൻ്റെ അടിസ്ഥാനത്തില്‍ രൂപവത്കരിക്കുന്ന ട്രിബ്യുണലുകള്‍ ആകും ഇനി തുടര്‍ നടപടികള്‍ സ്വീകരിക്കുകയെന്നും ഉത്തര്‍പ്രദേശ് സര്‍ക്കാര്‍ സുപ്രീം കോടതിയില്‍ വ്യക്തമാക്കി.

സ്വത്ത് കണ്ടുകെട്ടുന്നതിന് മുന്നോടിയായി നല്‍കിയ നോട്ടീസ് ഉത്തര്‍പ്രദേശ് സര്‍ക്കാര്‍ പിന്‍വലിച്ചില്ലെങ്കില്‍, ഉത്തരാറുകൾ എല്ലാം റദ്ദാക്കുമെന്ന് നേരത്തെ  സുപ്രിം കോടതി വ്യക്തമാക്കിയിരുന്നു. സർക്കാർ നീക്കത്തെ  രൂക്ഷമായ ഭാഷയിലാണ് സുപ്രീം കോടതി ആന്ന് വിമര്‍ശിച്ചത്. ഉത്തർ പ്രദേശ് സര്‍ക്കാരിൻ്റെ നടപടി നിയമവിരുദ്ധമാണെന്ന് ജസ്റ്റിസ് ഡി വൈ ചന്ദ്രചൂഡ് അധ്യക്ഷനായ ബെഞ്ച് നിശിതമായി വിമർശിച്ചിരുന്നു. 

പൗരത്വ ഭേദഗതി നിയമത്തിന് എതിരായ സമരങ്ങള്‍ക്കിടയില്‍ പൊതുമുതല്‍ നശിപ്പിച്ച കേസില്‍ നഷ്ടം  ഈടാക്കാനാണ് പ്രതിഷേധക്കാരുടെ സ്വത്ത് കണ്ടു കെട്ടാനുള്ള ഉത്തരവുകൾ ഇറക്കിയത്. എന്നാല്‍, സര്‍ക്കാര്‍ ഒരേസമയം പരാതിക്കാരെനെയും വിധികര്‍ത്താവിനെയും പ്രോസിക്യൂട്ടറേയും പോലെ  പ്രവര്‍ത്തിക്കുകയായിരുന്നുവെന്ന് സുപ്രീം കോടതി വിമർശിച്ചു. ഇത് നിയമ വിരുദ്ധ പ്രവർത്തിയാണെന്ന് ജസ്റ്റിസുമാരായ ഡി വൈ ചന്ദ്രചൂഡ്, സൂര്യകാന്ത് എന്നിവര്‍ അടങ്ങിയ ബെഞ്ച് വ്യക്തമാക്കി. ഇതേ തുടർന്നാണ് യു പി സർക്കാർ ഉത്തരവുകൾ പിൻവലിച്ച് അക്കാര്യം സുപ്രീം കോടതിയെ അറിയിച്ചത്. 

The Uttar Pradesh government has told the Supreme Court that it has withdrawn notices to confiscate the assets of those who took part in the protests against the Citizenship Law Amendment (CAA). The UP government has informed the Supreme Court that 274 notices have been withdrawn. The Supreme Court had sharply criticized the Uttar Pradesh government for issuing notices to seize the property of CAA protesters in violation of the rules. The Uttar Pradesh government has told the Supreme Court that the tribunals will be constituted under the amended law and will take further action.

Earlier, the apex court had said that if the Uttar Pradesh government did not withdraw the notice issued prior to the confiscation of the property, all the orders would be revoked. The apex court had criticized the government's move in harsh language. The bench, headed by Justice DY Chandrachud, had strongly criticized the Uttar Pradesh government's move as illegal. The order to confiscate the protesters' property was issued to recover damages in a case of destruction of public property amid protests against the Citizenship Amendment Act. However, the Supreme Court criticized the government for acting simultaneously as a plaintiff, a judge and a prosecutor. A bench of Justices DY Chandrachud and Suryakant said it was illegal. Following this, the UP government withdrew its orders and informed the Supreme Court.
