ലക്ഷദ്വീപ് - സ്‌കൂള്‍ കുട്ടികള്‍ക്കുള്ള ഉച്ചഭക്ഷണത്തില്‍ മാംസാഹാരം തുടരാമെന്ന് സുപ്രീം കോടതി

ലക്ഷദ്വീപിൽ സ്‌കൂള്‍ കുട്ടികള്‍ക്കുള്ള ഉച്ചഭക്ഷണ പദ്ധതിയില്‍ മാംസാഹാരം നൽകുന്നത് തുടരാന്‍ സുപ്രീം കോടതിയുടെ ഇടക്കാല ഉത്തരവ്. ഇതോടൊപ്പം  ദ്വീപിൽ അടച്ചുപൂട്ടിയ ഡയറി ഫാം തുറന്ന് പ്രവര്‍ത്തിപ്പിക്കാനും സുപ്രീം കോടതി നിര്‍ദേശിച്ചു. ലക്ഷദ്വീപിലെ ജനവിരുദ്ധ ഭരണപരിഷ്‌കാരങ്ങള്‍ക്ക് എതിരായ ഹര്‍ജിയില്‍ കേന്ദ്ര സര്‍ക്കാരും അഡ്മിനിസ്‌ട്രേറ്റര്‍ പ്രഫുല്‍ ഖോഡ പട്ടേലും ഉള്‍പ്പടെയുള്ള എതിര്‍ കക്ഷികള്‍ക്ക് സുപ്രീം കോടതി നോട്ടീസ് അയച്ചു.

ലക്ഷദ്വീപിലെ സ്‌കൂള്‍ കുട്ടികളുടെ ഉച്ചഭക്ഷണ പദ്ധതിയില്‍ നിന്ന് ചിക്കനും ബീഫും ഉള്‍പ്പടെയുള്ള മാംസാഹാരം ഒഴിവാക്കിയതും ഡയറി ഫാം അടച്ചുപൂട്ടിയതും ചോദ്യംചെയ്ത് കവരത്തി സ്വദേശി അജ്മല്‍ അഹമ്മദ് നൽകിയ ഹർജിയിലാണ് സുപ്രീം കോടതിയുടെ ഇടക്കാല ഉത്തരവ്. ജസ്റ്റിസുമാരായ ഇന്ദിര ബാനര്‍ജി, എ എസ് ബൊപ്പണ്ണ എന്നിവരടങ്ങിയ ബെഞ്ച്, അഹമ്മദ് നൽകിയ ഹർജി പരിഗണിച്ചാണ്, 2021 ജൂണ്‍ 22 ന് കേരള ഹൈക്കോടതി പുറപ്പടുവിച്ച ഇടക്കാല ഉത്തരവ് ഇനിയൊരു ഉത്തരവ് ഉണ്ടാകുന്നത് വരെ തുടരാന്‍ നിര്‍ദേശിച്ചത്. ദ്വീപിലെ ഭരണ പരിഷ്‌കാരങ്ങള്‍ സ്റ്റേ ചെയ്തുകൊണ്ടാണ് കേരള ഹൈക്കോടതി ഇടക്കാല ഉത്തരവ് പുറപ്പെടുവിച്ചിരുന്നത്.

അഡ്മിനിസ്‌ട്രേറ്റര്‍ പ്രഫുല്‍ ഖോഡ പട്ടേല്‍ ചുമതലയേറ്റ ശേഷമാണ് ദ്വീപ് വാസികളുടെ താത്പര്യം കണക്കിലെടുക്കാതെ ഇത്തരം പരിഷ്‌കാരം കൊണ്ടുവരുന്നതെന്ന് ഹര്‍ജിക്കാരനുവേണ്ടി ഹാജരായ സീനിയര്‍ അഭിഭാഷകന്‍ ഐ എച്ച് സയ്ദ്, അഭിഭാഷകരായ പീയൂഷ് കോട്ടം, ആബിദ് അലി ബീരാന്‍ എന്നിവര്‍ വാദിച്ചു. 1992 മുതല്‍ പ്രവര്‍ത്തിച്ചിരുന്ന ഡയറി ഫാം ആണ് അടച്ചുപൂട്ടാന്‍ നിര്‍ദേശിച്ചത്. അതുപോലെ പോഷക മൂല്യമുള്ള മാംസാഹാരമാണ് കുട്ടികളുടെ മെനുവില്‍നിന്ന് നീക്കിയതെന്നും അഭിഭാഷകര്‍ ചൂണ്ടിക്കാട്ടി. ഈ വാദം കണക്കിലെടുത്താണ് സുപ്രീം കോടതി ഇടക്കാല ഉത്തരവിറക്കിയത്.

ഇടക്കാല ഉത്തരവില്‍ വിവാദമായ തീരുമാനങ്ങള്‍ സ്റ്റേ ചെയ്തെങ്കിലും അന്തിമ ഉത്തരവില്‍ ലക്ഷദ്വീപ് ഭരണകൂടത്തിന്റെ നയപരമായ തീരുമാനങ്ങളില്‍ ഇടപെടാന്‍ കഴിയില്ലെന്നായിരുന്നു കേരള ഹൈക്കോടതി വ്യക്തമാക്കിയിരുന്നത്. ഇതിനെതിരെയാണ് ഹര്‍ജിക്കാരന്‍ സുപ്രീം കോടതിയെ സമീപിച്ചത്.

Supreme Court issues interim order to continue serving meat to school children in Lakshadweep The apex court also directed that the closed dairy farm on the island be reopened. The Supreme Court has issued notices to opposition parties, including the central government and administrator Praful Khoda Patel, on a petition challenging anti - people governance reforms in Lakshadweep.

Ajmal Ahmed, a native of Kavaratti, has filed an interim order challenging the exclusion of meat, including chicken and beef, from the Lakshadweep school lunch program and the closure of the dairy farm. The bench, comprising Justices Indira Banerjee and AS Bopanna, considered the petition filed by Ahmed and directed that the interim order issued by the Kerala High Court on June 22, 2021 be stayed till further orders. The Kerala High Court had issued an interim order suspending the administrative reforms in the island.

Senior counsel IH Syed, counsel Piyush Kottam and Abid Ali Beeran, appearing for the petitioner, contended that such an amendment was introduced after the appointment of Administrator Praful Khoda Patel without regard to the interests of the islanders. The dairy farm, which has been operating since 1992, was ordered to close. The lawyers also pointed out that nutritious meat was removed from the children's menu. In view of this argument, the Supreme Court issued an interim order.

The Kerala High Court had stayed the controversial decisions in the interim order but had stated in the final order that it could not interfere in the policy decisions of the Lakshadweep government. The petitioner approached the Supreme Court against this.
