വിവാദ ബിബിസി ഡോക്യുമെൻ്ററി - പൊതുതാല്‍പര്യ ഹർജികൾ ഫെബ്രുവരി 6ന് പരിഗണിക്കും

ബിബിസിയുടെ ‘ഇന്ത്യ: ദ് മോദി ക്വസ്റ്റ്യൻ’ എന്ന ഡോക്യുമെൻ്ററി സമൂഹമാധ്യമങ്ങളിലും ഓണ്‍ലൈന്‍ പ്ലാറ്റ്ഫോമുകളിലും വിലക്കിയതിനെതിരായ പൊതുതാൽപ്പര്യ ഹർജികൾ സുപ്രീം കോടതി ഫെബ്രുവരി 6ന് പരിഗണിക്കും. ചീഫ് ജസ്റ്റിസ് ഡി.വൈ.ചന്ദ്രചൂഡ്, ജസ്റ്റിസുമാരായ പി.എസ്.നരസിംഹ, ജെ.ബി.പർദിവാല എന്നിവരടങ്ങിയ ബെഞ്ചാണ് ഇക്കാര്യം വ്യക്തമാക്കിയത്. 2002 ലെ ഗുജറാത്ത് കലാപത്തിൽ പ്രധാനമന്ത്രി നരേന്ദ്ര മോദിക്കു പങ്കുണ്ടെന്ന് ആരോപിക്കുന്നതാണ് ബിബിസിയുടെ ‘ഇന്ത്യ - ദ് മോദി ക്വസ്റ്റ്യൻ’ എന്ന ഡോക്യുമെൻ്ററി.

അഭിഭാഷകനായ എം.എല്‍.ശര്‍മ, മുതിർന്ന അഭിഭാഷകൻ സി.യു.സിങ് എന്നിവരാണ് ഹർജികൾ അടിയന്തരമായി പരിഗണിക്കണമെന്നാവശ്യപ്പെട്ട് കോടതിയെ സമീപിച്ചത്. മുതിർന്ന മാധ്യമപ്രവർത്തകൻ എൻ.റാം, ആക്ടിവിസ്റ്റും അഭിഭാഷകനുമായ പ്രശാന്ത് ഭൂഷൺ, തൃണമൂൽ കോൺഗ്രസ് എംപി മഹുവ മൊയ്ത്ര എന്നിവരും സുപ്രീം കോടതിയെ സമീപിച്ചിട്ടുണ്ട്. ഡോക്യുമെൻ്ററിയെ കുറിച്ചുള്ള എൻ.റാമിന്റെയും പ്രശാന്ത് ഭൂഷണിന്റെയും ട്വീറ്റുകൾ നീക്കം ചെയ്തത് സി.യു.സിങ്ങിന്റെ ഹർജിയിൽലും ചൂണ്ടിക്കാട്ടിയിട്ടുണ്ട്.

ഐടി ചട്ടപ്രകാരമാണ് കേന്ദ്ര സർക്കാർ സര്‍ക്കാര്‍ ഡോക്യുമെന്‍ററി വിലക്കിയത്. ഇത് അഭിപ്രായ സ്വാതന്ത്ര്യത്തിന്റെ നിഷേധമാണെന്ന് ഹർജിക്കാർ ചൂണ്ടിക്കാട്ടുന്നു. ഇരകളുടെയും മുന്‍ പൊലീസ് ഉദ്യോഗസ്ഥരുടെയും അഭിമുഖങ്ങള്‍ ഉള്‍പ്പെടുത്തിയുള്ള സ്വതന്ത്ര സൃഷ്ടിയാണ് ഡോക്യുമെന്‍ററി. ഡോക്യുമെൻ്ററിക്ക് കേന്ദ്രസർക്കാർ നിരോധനം ഏർപ്പെടുത്തിയത് ഭരണഘടനാ വിരുദ്ധമാണെന്നും എം.എൽ.ശർമയുടെ ഹർജിയിൽ പറയുന്നു. ഡോക്യുമെന്ററിയുടെ ഒന്നും രണ്ടും ഭാഗങ്ങൾ പരിശോധിക്കണമെന്നും 2002ലെ ഗുജറാത്ത് കലാപത്തിൽ നേരിട്ടും അല്ലാതെയും ബന്ധപ്പെട്ടവർക്കെതിരെ നടപടിയെടുക്കണമെന്നും ഹർജിയിൽ ആവശ്യപ്പെട്ടിട്ടുണ്ട്.

Controversial BBC Documentary - Public Interest Litigation to be heard on February 6

The Supreme Court will hear the Public Interest Litigation on February 6 against the banning of the BBC's documentary 'India: The Modi Question' on social media and online platforms. This was clarified by a bench comprising Chief Justice DY Chandrachud, Justices PS Narasimha and JB Pardiwala. The BBC's documentary 'India - The Modi Question' alleges Prime Minister Narendra Modi's involvement in the 2002 Gujarat riots.

Advocate ML Sharma and senior advocate CU Singh approached the court requesting urgent consideration of the petitions. Veteran journalist N. Ram, activist and lawyer Prashant Bhushan and Trinamool Congress MP Mahua Moitra have also approached the Supreme Court. C.U.Singh's petition also pointed out that the tweets of N. Ram and Prashant Bhushan about the documentary had been removed.

According to the IT rules, the central government banned the government documentary. The petitioners point out that this is a denial of freedom of expression. The documentary is an independent work featuring interviews with victims and former police officers. According to ML Sharma's petition, the central government's ban on the documentary is unconstitutional. The petition has demanded that the first and second parts of the documentary be examined and action be taken against those directly and indirectly involved in the 2002 Gujarat riots.
