മാന നഷ്ട കേസ് : രാഹുൽ ഗാന്ധിക്ക് 2 കൊല്ലം തടവ് ശിക്ഷ

‘എല്ലാ കള്ളന്‍മാരുടെയും പേരില്‍ മോദി എന്നുണ്ട്. നീരവ് മോദി, ലളിത് മോദി, നരേന്ദ്ര മോദി. എന്താണ് ഈ കള്ളന്മാര്‍ക്കെല്ലാം മോദി എന്നു പേരു വരുന്നത്?’’  എന്ന 2019ൽ കർണാടകയിലെ ലോക് സഭാ തിരഞ്ഞെടുപ്പ് പ്രചാരണത്തിൽ നടത്തിയ വിവാദ പരാമർശത്തെ തുടർന്ന് രെജിസ്റ്റർ ചെയ്ത കേസിലാണ് ഇപ്പോൾ ശിക്ഷാ വിധി വന്നിട്ടുള്ളത്. സൂറത്ത് ചീഫ് മജിസ്ട്രേറ്റ് കോടതിയുടേതാണ് ഉത്തരവ്. രാഹുൽ ഗാന്ധി കുറ്റക്കാരനെന്ന് കോടതി നേരത്തെ വിധിച്ചിരുന്നു. 2019 ലെ ലോക്‌സഭ തിരഞ്ഞെടുപ്പ് പ്രചാരണത്തിനിടയിൽ പ്രധാന മന്ത്രി നരേന്ദ്ര മോദിയെ ഉന്നംവെച് നടത്തിയ പരാമർശമാണ് ഇപ്പോൾ രാഹുൽ ഗാന്ധിക്ക് വിനയായി വന്നിരിക്കുന്നത്. 

രാഹുൽ ഗാന്ധി പരാമർശിച്ച, പ്രധാന മന്ത്രി നരേന്ദ്ര മോദി അടക്കം ആരും തന്നെ മാനനഷ്ട കേസ് കൊടുത്തിരുന്നില്ല. എന്നാൽ ഗുജറാത്തിലെ മുൻ ബിജെപി മന്ത്രിയും നിലവിലെ MLA യും ആയ പൂർണേഷ് മോദി, രാഹുൽ ഗാന്ധിയുടെ പരാമർശം മോദി സമുദായത്തിന് തന്നെ മാനക്കേട് ഉണ്ടാക്കി എന്ന് കാണിച്ച് നൽകിയ മാനനഷ്ട കേസാണ് ഇപ്പോൾ വിധി ആയിരിക്കുന്നത്. മന നഷ്ട്ട കേസിൽ നൽകാവുന്ന പരമാവധി തടവ് ശിക്ഷയായ രണ്ട് കൊല്ലമാണ് ഇപ്പോൾ രാഹുൽ ഗാന്ധിക്ക് എതിരെ സൂറത്ത് ചീഫ് മജിസ്ട്രേറ്റ് കോടതി വിധിച്ചിരിക്കുന്നത്. ഏതെങ്കിലും കേസിൽ ഒരു ജന പ്രധിനിധി രണ്ട് കൊല്ലമോ അതിലധിക്കാമോ കാലത്തേക്ക് ശിക്ഷിച്ചാൽ ജനപ്രാതിനിധ്യ നിയമ പ്രകാരം ജന പ്രധിനിധി ശിക്ഷാ കാലാവധിയും തുടർന്ന് 6 കൊല്ലത്തേക്കും അയോഗ്യനാക്കപ്പെടും. മാപ്പ് പറയുന്നുണ്ടോ എന്ന കോടതിയുടെ ചോദ്യത്തിന് മാപ്പ് പറയുന്നില്ല എന്നായിരുന്നു രാഹുൽ ഗാന്ധിയുടെ മറുപടി. 

വയനാട് എംപി രാഹുൽ ഗാന്ധിയെ ലോക്സഭയിൽനിന്ന് അയോഗ്യനാക്കി

രണ്ട് കൊല്ലം ജയിൽ ശിക്ഷ ലഭിച്ചതോടെ 1951ലെ ജനപ്രാതിനിധ്യ നിയമത്തിലെ സെക്‌ഷൻ 8(3) പ്രകാരം പാര്ലിമെന്റിൽനിന്ന് അയോഗ്യനാക്കപ്പെടും. വിധി പകർപ്പ് ലോക് സഭാ സെക്രട്ടറിയേറ്റിൽ ലഭിക്കുന്നതോടെ ലോക്‌സഭാ സെക്രട്ടറിയേറ്റ് രാഹുൽ ഗാന്ധിയെ ലോക്സഭയിൽ നിന്ന് അയോഗ്യനാക്കാനുള്ള നടപടികൾ ആരംഭിക്കും. നിലവിലെ രാഷ്ട്രീയ സാഹചര്യത്തിൽ അയോഗ്യനാക്കുന്നതിനുള്ള നടപടികൾ ദ്രുതഗതിയിൽ പൂർത്തിയാക്കാനുള്ള സാധ്യതയാണ് വിദഗ്ദ്ധർ കാണുന്നത്. നിലവിൽ കോടതി വിധിക്ക് എതിരെ അപ്പീൽ നൽകാൻ 30 ദിവസത്തെ സാവകാശവും, രാഹുൽ ഗാന്ധിക്ക് ജാമ്യവും കോടതി അനുവദിച്ചിട്ടുണ്ട്.

The verdict has now come in a case registered following a controversial remark made during the Lok Sabha election campaign in Karnataka in 2019, The order belongs to the Surat Chief Magistrate Court. The court had earlier found Rahul Gandhi guilty. During the 2019 Lok Sabha election campaign, Rahul Gandhi's remarks against Prime Minister Narendra Modi have come as an insult.

Rahul Gandhi mentioned that no one, including Prime Minister Narendra Modi, had filed a defamation case. But the verdict is now a defamation case filed by Purnesh Modi, a former BJP minister and current MLA in Gujarat, alleging that Rahul Gandhi's remarks insulted the Modi community. The Surat Chief Magistrate's Court has now sentenced Rahul Gandhi to two years, which is the maximum jail term that can be given in the defamation case. In any case, if a representative of the people is convicted for a term of two years or more, the representative of the people shall be disqualified for the term of the punishment followed by 6 years under the Representation of the People Act. Rahul Gandhi replied that he is not apologizing to the court's question whether he is apologizing.

After being sentenced to two years in prison, he will be disqualified from Parliament under Section 8(3) of the Representation of the People Act, 1951. Once the copy of the judgment is received by the Lok Sabha Secretariat, the Lok Sabha Secretariat will start the process to disqualify Rahul Gandhi from the Lok Sabha. Experts see the possibility of speedy completion of the disqualification process in the current political climate. Currently, the court has granted bail to Rahul Gandhi and 30 days to file an appeal against the court verdict.
